We have just received a copy of Anthony Z. Roisman's letter of January 10, 1979 to the Cocaission asking that the Palo Verde Units 4 and 5 licensing hearing be made a test case for intervenor. funding. We assume that the Commission will not seriously consider this proposal in light of its 1976 ruling that the Coraission lacked authority to provide in -

tervenor funding.

As to the generic issue of intervenor funding, we fully support the Office of ManNement Budget view of this matter that the responsibility for making determinations in this area rests with Congress, not the Nuclear Regulatory Coraission. Moreover, if an intervenor funding test is to be made at all, it should be done in a hearing on a generic issue, not a proceeding involving the licensing of a particular plant.

  • Such a move would make an already unwieldy and lengthy licensing pro-cess even more onerous for applicants.

In sum, we believe that the Palo Verde 4 and 5 proceeding is certainly not the place to test the concept of intevenor funding and if there are any safety concerns, that they be examined generically. If the Coraission does seriously entertain the Roisman proposal, we would~

insist that we be a party to this process.
