1. PROJECT TITLE Technical and Rulemaking Support of 10 CFR Part 26, Fitness for Duty Programs

2. BACKGROUND Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Fitness for Duty [FFD]

Programs, promotes public health and safety and the common defense and security through Nuclear Regulatory Commission (NRC)-licensee implementation of Part 26 requirements. These requirements are designed to provide reasonable assurance that personnel are fit for duty, meaning, in part, that they are trustworthy, reliable, and not under the influence of any substance, legal or illegal, or mentally or physically impaired from any cause, which in any way adversely affects their ability to safely and competently perform their duties. The Part 26 requirements include, but are not limited to drug and alcohol testing, behavioral observation, and fatigue management. The FFD program is also one key program element of the Insider Mitigation Program required by 10 CFR 73.55(b)(9), which is part of the NRC-approved security plan, and integral to 10 CFR Part 73, access authorization security requirements.

The NRCs Office of Nuclear Security and Incident Response (NSIR) plans, coordinates, and manages the overall development and implementation of security-related policies, programs, and inspection activities, and incident response. Within this capacity, NSIR has overall responsibility for all Part 26 drug and alcohol and behavioral observation provisions and a support responsibility for oversight of the Part 26 fatigue management provisions (10 CFR Part 26, Subpart I). The staff leads agency efforts in developing policy, guidance, and rulemaking for the Part 26 drug and alcohol testing, FFD authorization, and behavioral observation requirements. The staff also leads review, development, evaluation, writing, and presentation of all technical elements of FFD programs, documentation, including but not limited to inspector and licensee guidance documents, electronic reporting of FFD program information, event assessment, and industry performance trending.

Regarding rulemaking, NSIR supports the program offices in the promulgation of the rules, because NSIR does not have rulemaking authority. The Part 26 rule, in general, applies to the following licensees:

power reactors licensed to operate; power reactors being constructed; Category I fuel cycle facilities; and, contractors and vendors who implement Part 26 provisions for the aforementioned licensees.

NRC-HQ-25-14-E-0004 NRC-HQ-11-15-T-0001 M0010 Attachment 1 Although the following licensees are not currently within scope of Part 26, changes made to Part 26 and its associated guidance have the potential to affect or impact the following facilities:

general- and specific-licensed independent spent fuel storage installations (ISFIS)

(potential impact, because some ISFSIs are co-located at a commercial power reactor site);

decommissioning power reactors (potential impact, because the 10 CFR Part 73.55 Insider Mitigation Program applies elements of 10 CFR Part 26); and, non-power production or utilization facility (NPUF) (potential impact, because these licensees utilize NRC-licensed operators, pursuant to 10 CFR Part 55, to manipulate reactivity controls and because some NPUF licensees have voluntarily implemented drug testing).

During the period of performance for CLINS 0001 - 0003, contracted work was completed to supplement NRC-staff activities associated with the FFD information technology (IT) infrastructure and a NRC staff-proposed rulemaking entitled Tech Issues Rulemaking, which involved technical papers in support of its regulatory basis development phase.

During the period of performance for CLIN 0004, the contractor shall assist NRC-staff in maintaining and enhancing the FFD IT infrastructure, guidance development, and technical assessment of public comments resulting NRC Commission-directed rulemaking described in SRM-SECY 17-0027, Proposed Rulemaking: Fitness-for-Duty Drug Testing Requirements (RIN 3150-AI67). 3. PROJECT DESRIPTION AND OBJECTIVE This SOW for this Task Order falls within the unrestricted part of NRC IDIQ Enterprise-Wide Contract (EWC) entitled Technical Assistance in Support of Agency Environmental and Reactor Programs, paragraph 3.4, Regulatory Infrastructure.

The contracted work activities described herein are considered mission critical in direct support of NRC rulemaking activities and regulatory oversight and licensing of NRC licensees and other affected entities subject to Part 26. Specifically, the contracted work facilitates timely issuance of NRC guidance, resolution of public comments, and efficient and effective licensee submission of NRC-required information and NRC staff assessment of this information to directly assist NRC inspection and inform NRC policy and guidance.

Furthermore, the NRC does not possess the technical capability to maintain the FFD IT infrastructure nor forensic toxicology expertise to assess laboratory performance and complexities associated with medical review officer determinations. This latter capability is expected to directly support NRC-staff assessment of stakeholder comments on the draft proposed rule described in SRM-SECY-17-0027. The specific work activities are summarized below and detailed further in SOW Section 4 - Statement of Work Tasks, Table 1 - Project Plan for CLIN 0004.

Task 1: Technical Effort - Reviews and Electronic Reports Task 1 includes the review, development, and documentation of analyses associated with FFD-related events or technical issues and maintenance and enhancement of the FFD IT infrastructure. For CLIN 0004, the contractors objective is to provide technical analyses that informs NRC policy and inspection activities. Technical reviews and associated reports by an independent contractor enhances the timeliness and quality of NRC staff reviews.

The deliverables from this effort includes maintaining and enhancing the current FFD IT infrastructure which consists of:

(1) three NRC-issued electronic forms (Forms 890, Single Positive Test Form; 891, Annual Reporting Form, and 892, Annual Fatigue Reporting Form) used by NRC licensee and other entities to report FFD performance information to the NRC. (2) The FFD Desktop Application, which is used to evaluate licensee FFD performance and; (3) the Cost Assessment and Analysis Tool (CAAT), which is used to inform NRC staff assessment of FFD program costs and risks.

Task 1 also includes continuing work on technical issues learned from inspection, operating experience, rulemaking, and policy reviews (colloquially called frequently asked questions, FAQs). The deliverable from this activity will be maintenance and updating of the FAQ database and a draft version of an NRC NUREG. Lastly, Task 1 continues the use of a contracted expert (i.e., key person) in to assist the NRC staff in the assessment of, in part, forensic toxicology information or drug testing laboratory processes.

Task 2: Rulemaking Under the Atomic Energy Act of 1954 and the Energy Reorganization Act of 1979, the NRC was directed to control the possession, use, and production of atomic energy and special nuclear material, as to make the maximum contribution to the common defense and security and national welfare. The NRC was further directed to license and regulate facilities involved in such activities. The establishment of regulations is called rulemaking.

Task 2 includes the investigation, review, development, and documentation of technical, financial, and legal bases for Part 26-related rulemaking. Under CLIN 0004, the principal deliverable is expected to be technical assessment of stakeholder comments resulting from SRM-SECY 17-0027, Proposed Rulemaking: Fitness-for-Duty Drug Testing Requirements, specifically, the contract shall provide technical assistance with compiling, aggregating, managing, and answering internal and external stakeholder questions. If time and funding permit, that the contractor may continue to the development of certain rulemaking deliverables, as directed by the COR. These 7

4. STATEMENT OF WORK TASKS As described in the previous section, this task order is organized into two tasks: Task 1, Technical Effort - Reviews and Electronic Reports, and Task 2, Rulemaking. The approved project plan in Table 1 details the contractors specific requirements and deliverables, subject to the direction provided in Table 1. Periodic teleconferences will be conducted within each task to communicate technical direction and funding, planning, and status information; time for teleconferences will be charged to the respective task.

Estimates of the level of effort (e-LOE) are provided for planning purposes.

7. ESTIMATED LEVEL OF EFFORT/REQUIRED LABOR CATEGORIES AND REQUIRED PERSONNEL QUALIFICATIONS The e-LOE in professional staff days (where one staff day is 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> within a 24-hour period) apportioned among the tasks and by labor category is detailed below to assist in project management and planning. Assume the indicated level of effort for the identified labor category for estimating purposes only. The hours may fluctuate between categories during the course of this task order depending on NRC priority for this task order which may evolve over time during this rulemaking. The e-LOE shall not be used during project implementation as cost floors or ceilings unless specified by the COR. COR can add columns to the e-LOE table for Subtask and Priority if they are necessary for the effort.

COR assumed FY 2020 fully loaded wage rate for all 3 months. Due to funding limitations, COR will work with contractor to timely reassess fact of life changes on the completion of high priority tasks.
