License Amendment Fee for Proposed Change No. 161 (Reference b)
Your letter, Reference (d), has again avoided a discussion of our arguments against payment of the requested fee of $4,000.00. Yankee shares the Commissions role in assuring that conditions exist for safe plant operation, and that the health and safety of the public not be endangered. However, our efforts to expeditiously address the LTOP issue (previously recognized by Yankee) were not reciprocated by your technical staff. We submitted for your review the appropriate design /
procedural changes necessary to provide automatic protection in the unlikely event of a LTOP. After 14 months we learned that your staff chose to not only ignore our submittal, but insisted we adopt their latest criteria / modifications. Your inactivity regarding our timely LTOP submittal resulted in the ultimate docketing of our Technical Specifications after the fees in 10CFR Part 170 were established, and this fact makes any payment repugnant.
We still maintain that Yankee, and its ratepayers, are being penalized for obvious staff review delinquency. Yet we also recognize the authority vested in 10CFR2.202, and although we believe your position 0{
is unjust, enclosed herewith is a check for $4,000 as payment under protest of the license amendment fee for our Proposed Change No. 161, 0

United States Nuclear Regulatory Comission Attention: William O. Miller, Chief Page 2 June 5, 1979 Yankee Atomic Electric Company believes that the Comission's revised fee schedule is illegal, and has petitioned for review thereof to the U. S. Court of Appeals for the Fifth Circuit. For this reason and the reasons stated in Yankee's letter to the Comission dated October 16, 1978, the license fee filed herewith is submitted under protest, and without waiver of the Company's right to contend that it should be refunded in whole or in part.
