Intervenors, Conservation Council of North Carolina and Wake Environment, Inc., respectfully show unto the Commission the following:
1.
The Initial Decision (ID) authorizing construction of tne Shearon Harris Nuclear Power Plant was rendered on January 23, 1978, LBP-78-4, 7NRC 32 (1978) and was affirmed by the Appeal Board on August 29,1978 ALAB-490, ONRC 234 (1978). Prior to the Initial Decision and its affirmance by tne Appeal Boarc, the Nuclear Regulatory Commission had published WASH-1400 (The Rasmussen Repor.),
praising it as a " realistic assessment.
., providing an objecti/e and meaning-ful estimate of the present risks associated with the operation of preser.t daj light water reactors in the United States," and stating tnat "the final report is a soundly based and impressive work.... Its overall conclusion is tna tne risk attached to the operation of nuclear power plants is very ico compared sitn other natural and masmade risks."

Subsequent to the publication of the Rasmussen Recort an ac,oc ns<
assessment review group published a report to the U. S. Nuclear Reguiatory C;m-mission (NUREG/CR-0400) which severely criticized many aspects of the Rasmussen

eport. As a result of itVREG/CR-0400 (The Lewis Report), the Nuclear Regulatory Commission issued a policy statement on January 18, 1979, in which it stated "The Comission withdraws any explicit or implicit past endorse-inter alia:
ment of _the Executive Summary [of the Rasmussen Report].... The Commission accepts the Review Group Report's conclusion th.it absolute values of the risks presenteo by WASH-1400 should not be used uncritically either in the regulatory process or for public policy purposes and has taken and will continue to take stens to assure that any such use in the past will be corrected as appropriate.
In particular, in light of the Review Group conclusions on accident probabilities, the Commission does not regard as reliable the Reactor Safety Study's numerical estimate of the overall risks of reactor accident."

move to remand this proceeding to the Licensing Board or, in the alternative, petition to reopen the case before the Licensing Board for the reception of new contentions relating to the effects of the Lewis Report upon the Shearon Harris proceeding.
