Dear Sir:

In response to your letter of November 28, 1978, we are providing the information requested in your Request for Additional Information Concern-ing the Proposed Transportation of Crude Oil by Rail Across the Trojan Exclusion Area. The majority of the information that will follow was obtained from discussions with Burlington Northern Railroad (BN) offi-cials. The following responses correspond to the numbering of your Request for Additional Information.

1.

As briefly discussed in our letter of December 29, 1978 to you, we have confirmed that the General American Transpor-tation Corporation and Exxcn have abandoned the project associated with their Environmental Impact Statement on the Port Westward oil terminal. Also, we have been advised by BN that they have no knowledge of any other compa. ties intert::ted in terminaling crude cetroleum at Port Westward.

We therefore arc. confident tha t.

there are no plans for large-scale transportation of petroleum products across the Trojan site.

2.

We have been advised that the BN trackage on the Trojan property is rated as Federal Railroad Administration Class 3.

A 40-mph speed limit is imposed along this trackage.

3.

We have been advised by BN that no significant quantities of petroleum products (produced at Cutbank or elsewhere) will be shipped a. ross the site.

Since crude oil will not be transported across the Trojan site, as discussed in Items 1 and 3 above, and we have also 7902130Igi

Mr. A. Schwencer February 6, 1979 Page two been advised by BN that no other flammable liquids are transported across the Trojan site, a hazardous puddling situation following a postulated derailment will not arise.

Not withstanding this lack of hazard potential, we have determined that the following applies:

the BN rail track-age across the site is at El 25 f t, and the Plant grade elevation for safety-related equipment is El 45 ft.

We have been advised by BN that the Federal Government requires that the train engineer and conductor be knowl-edgeable of each commodity transported in each train.

Explosives are specifically identified by plackard as per Federal Hazardous Material Regulations. There are presently no requirements for BN personnel to inform PGE of flummable/ explosive / hazardous material shipments on the onsite portion of the BN trackage.

Attached is a copy of the agreement between PGE and BN that provides PGE with the authority to control rail traffic traversing the Trojan Exclusion Area during emer-gency conditions. As discussed in Item 5 above, there are no specific arrangements for controlling flammable /

explosive / hazardous shipments through the Trojan site.

7.

Since BN has advised PGE that they carry no significant crude oil or other hazardous / flammable / explosive material that could cause a fire or explosion across the Trojan site, no additional analyses beyond what is presented in the Trojan FSAR are considered required to support our conclusion that no transportation accident can adversely af fect Plant safety-related structures or equipment.

_A G _R _E E _M E N_ T_

THIS AGREEMENT is made this date by and between PORTLAND GENERAL ELECTRIC COMPANY ("PGE"), a corporation, with general offices located at 121 SW Salmon Street, Portland, Oregon, and BURLINGTON NCRIHERN INC., with general of fices located at 176 East Fifth Street, S t.

Paul, Minnesota.

WHEREAS, PGE owns and operates its Trojan Nuclear Plant located on the Oregon shore of the Columbia River and BURLINGTON NORTHERN INC., owns and operates a railroad through the Trojan Nuclear Plant premises; and NHEREAS, BURLINGTON NORTHERN INC., is willing to limit uses and permit PGE to exercise jurisdiction over certain parts of its land in accordance with the provisions herein; now, therefore, IN CONSIDERATICU of the mutual covenants herein, it is agreed as follows:

(1) There is hereto attached, marked Exhibit "A" and made a part of this Agreement, a plat showing BURLINGTCN NORTHERN INC'S., right of way within the area of PCE's Trojan Nuclear Plant (" Area").

This Agreement covers that portion of SURLINGTON NORTHERN INC' S., right of way shown in yellow on said attached Exhibit.

(2) PGE is hereby granted authority and permission to remove or order the removal of all persons and their property from the Area, except agents, employees and invitees of BURLINGTON 3.5-2 Amendment 7 (May 1978) 1 - AGREEMENT

NORTHERN INC., and to exercise such privileges as though PGE were the owner of said railroad tracks and lands within the Area.

In addition, PGE is authorized to erect and maintain appropriate signs to advise any person within the Area of the limitation of use and exclusions provided for herein.

However, before any such signs are erected the content and placement of the signs shull be approved by BURLINGTON NORTHERN, INC'S.,

superintendent at Portland, Oregon.

(3) BURLINGTON NORTHERN INC., retains all rights to use its property for its own purposes and to carrs nn and operate and maintain a railroad thereon; and in so doing, itr agents, employees and invitees shall have unrestricted access to the Area, except at such times as there may.be a radiation emergency as herein-after provided.

Residential use and overnight camping in the Area shall be prohibited.

(4) In addition to the authority granted to PGE herein, when advised by PGE that a radiation emergency exists at the Trojan Nuclear Plant, or a threat thereof which might unduly expose the public or railroad personnel, BURLINGTON NORTHERN INC., agrees to tem,orarily halt rail activities and traffic over its track and within the Area for the duration of such radiation emergency or threat.

(5) The privileges granted to PGE herein may be performed without prior I.^tification of BURLINGTCN NORTHIPli INC.,

(except for sign approval as heretofore specified) ; however, as soon as

practicable, following the exercise of such privileges, PGE shall notify BURLINGTON NORTHERN INC., thereof, including the facts and circumstances surrounding the events.

Such notification shall be made by telephone to the Chief Dispatcher (285-5095 at Portland, or 695-0106 at Vancouver) and confirmed by letter to the Portland Division Superintendent of BURLINGTCN NORTHERN INC., at PO Box 571, Portland, Oregon 97207.

In the event of a change of telachone numbers or a change of address, or either, notification shall be in accordance with such change.

(6) In consideration of the rights and privileges granted hereby, PGE shall indemnify and save harmless BURLINGTCN NORTHERN INC., SPOv:.NE, PORTLAND and SEATTLE RAILWAY COMPANY, and all other persons or railroad ccmpanies lawfully using the railroad right of way within.the Area, from any and cll claims, suits, losses, expenses, damages, delay claims and detour losses and expenses, whether or not any of the same may be contributed to by the action or negligence of SURLINGTCN NORTHERN INC., or any of the said companies, their agents or employees, arising or growing out of exercise of the rights and privileges granted to PGE herein.

(7) This Agreement replaces that certain Agreement bet.ieen the same parties dated November 20, 1973.
