This letter concerns our review of the Tri-State Motor Transit Company Contingency Plan for Road Transportation which was transmitted to us by your letter of September 12, 1978. On the basis of our review, we have determined that your plan is acceptable subject to the changes /
modifications as noted in the margins of the plan (enclosed).
Formal review of the Procedures Summary (Appendix D) was not performed.
Though the Procedures Summary is a part of the safeguards contingency plan, it need not be submitted to NRC for approval (10 CFR 73-Appendix C) because the procedures contain operating detail subject to frequent change. The licensee is responsible, however, for ensuring that imple-menting procedures reflect the most recent information in the responsi-bility matrix with respect to responding entities.
Please make the changes / corrections / additions / deletions as appropriate and furnish us six copies of your finalized plan as soon as possible.
The plan will become effective on January 15, 1979.
We have determined that the enclosure to your letter of September 12, 1978 contains information of a type specified in 10 CFR 2.790(d). Ac-cordingly, it is deemed to be commercial or financial information within che meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordmce with the provisions of 10 CFR 9.12.
