APPENDIX A NOTICE OF VIOLATION United Nuclear Corporation Docket No.70-371 Based on the results of the NRC inspection conducted on October 4-6, 1978, it appears that certain of your activities were not conducted in full compliance with the conditions of your license.
Both items are Infractions.
A.
Part I, Chapter 4, Section 4.1, paragraph 4.1.2 of the facility license SNM-368 states, "Any gaseous or liquid effluent discharge samples that are 25% of the 10 CFR Part 20 limits shall be immediately resampled and an investigation of the source of the release shall be made. Samples which are as high as 50% of the 10 CFR 20 limits shall result in partially restricted operation and an increase in sampling frequency for determining the source of the release problem.
If samples exceed 50% of the 10 CFR Part 20 limits, an evaluation shall be made to determine if a shutdown is necessary."
Contrary to the above, on at least 11 occasions, during the period July 1977 through September 1978, the required actions and necessary evaluations were not perfomed in response to gaseous effluent samples demonstrating radioactivity in excess of 25% and 50% of the 10 CFR Part 20 limits.
B.
Part I, Chapter 2, Section 2.7, paragraph 2.7.1 of the facility license SNM-368 requires, in part, "A continuous re-appraisal of the safety program shall be provided through a system of daily checks, regular inspections, and audits....Results of daily checks, inspections, and audits shall be documented and all observed deficiencies including corrective action initiated and/or completed, shall be included in the documentation." Section 6.8.3 of the facility Emergency Plan states, " Reports of the results of each drill on perfomance and adequacy shall be made to the General Manager as part of the plant auditing program."
Contrary to the above, required reports, as part of the plant auditing program, were not made to the General Manager for the various emergency drills conducted during the period July 1977 through September 1978.
