Dear Mr. Linder:

The Comission has issued the enclosed Amendment No.18 to Provisional Operating License No. DPR-45 for the la Crosse Boiling Water Reactor. The amendment consists of changes to the license and its appended Technical Specification: in response to your application dated April 20, 1978, as supported by information transmitted by letters dated June 7, July 11, August 7, September 25, October 4, October 26, No-vember 20 and November 29, 1978; January 4, January 31, February 14, March 1, May 17, June 26, July 11 and August 6,1979.

The amendment approves your design concept of the crash pad and revises the provisions of the Technical Specifications to allow increase in the capacity of the spent fuel storage pool from 134 to 440 fuel assemblies. This action, in-cluding the change to Technical Specification 2.12.3 required by the Atomic Safety and Licensing Board (ASLB), is in accordance with the ASLB's Initial Decision dated January 10, 1980, as modified January 17, 1980.

Enclosed is a revision to our Safety Evaluation (SE), dated July 13, 1979. Pages 2, 3, 4, 8 and 13 of the July 13, 1979 SE were revised by deleting reference to the use of zircaloy fuel. This revised SE and the Impact Appraisal issued by our letter date July 13, 1979, support the portions of the amendment involving the expansion of the spent fuel storage pool capacity and the pool crash pad design.

The amendment also revises Paragraphs 2.B(2), 2.B(3)a-f, and 2.B(4) of License No.

DPR-45 to incorporate a more generalized format relative to the authority for the receipt, possession and use of special nuclear, byproduct and source materials.

Moreover, the amendment revises the Technical Specifications to incorporate limiting condition for operation and surveillance requirements for sealed sources. A dis-cussion of our review and evaluation relating to this portion of the action follows.

By application dated April 20, 1978, and supplement thereto dated August 6, 1079, you proposed changes which would replace specific descriptions of special nuclear, byproduct and source materials in License No. DPR-45 with a generalized format consistent with the model issued by our letter dated January 24, 1975. The existing provision, however, authorizing the receipt, possession and use of 10 curies of Cesium-137 for instrument calibrations would remain in effect. This is the only by-product material source in excess of 100 millicuries that you are allowed to receive, possess and use. Your August 6,1979 submittal also proposed technical specifications for limiting condition for operation and surveillance requirements for sealed sources.

Based on our review of your request, we found it necessary to modify your pro-posed Technical Specifications to make them consistent with the provisions of the Standard Technical Specifications for boiling water reactors. These modi fications have been discussed with and agreed to by your representative.

We have determined that the proposed Technical Specifications, as modified, and the procedures for safe handling of radioactive materials at La Crosse provide reasonable assurance that special nuclear, source and byproduct materials would be stored, used, and accounted for in a manner which meets the applicable radiation protection requirements of 10 CFR Parts 20, 30, 40 and 70. We, there-fore, find the incorporation of flexible yet controlled licensing provisions for the receipt, possession and use of special nuclear, source and byproduct materials into License No. DPR-45 and the proposed changes to its appended Technical Speci-fications acceptable.

The portion of the amendnent which applies to the materials provisions does not authorize a change in effluent types or total amounts nor an increase in power level, and will not result in any significant environmental impact.

Having made this determination, we have further concluded that this portion of the amendment involves an action which is insignificant from the standpoint of environmental impact and pursuant to 10 CFR $51.5(d)(4) that an environmental impact statement, or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of flexible materials provisions and the related Technical Specifications.

The portion of the amendment applicable to the materials provisions does not in-volve significant new safety information of a type not considered by a previous Commission safety review of the facility.

It does not involve a significant in-crease in the probability or consequences of an accident, does not involve a significant decrease in a safety margin, and, therefore, does not involve a significant hazards consideration. We have also concluded that there is reason-able assurance that the health and safety of the public will not be endangered by this portion of the action and that the issuance of flexible materials pro-visions and the related Technical Specifications will not be inimical to the common defense and security or to the health and safety of the public.

A copy of the combined Notice of Issuance and Negative Declaration is also enclosed.
