ORDER (February 4, 1930)

On January 24, 1980, the Applicant filed a Motion To Compel TexPirg To Answer Interrogatories; And Request For Extension Of Discovery.

In a letter dated January 29, 1980, Applicant advised that it had received the responses to these interrogatories and accordingly it withdrew the instant motion to compel.

However, in light of the alleged untimeliness of the responses, Applicant requests that the Board grant its request for an extension of time.

In its response of January 28, 1980, TexPirg opposed the request for an extension unless other parties are also given such an extension of time; however, the Appeal Board and this Board have repeatedly stated that, absent authorization, one party may not represent the interest of others.

Further, in the instant matter, TexPirg has not shown good cause for requesting an extension of time upon its own behalf.

Good cause having been shown in that the responses were not received until January 29, 1980, the request for an extension of time is granted and Applicant shall have until February 27, 1980 within which to complete 8002130 3Tl g

its discovery against TexPirg on the contentions admitted by stipulation during the prehearing conference held between October 15 and October 19, 1979.

IT IS 50 ORDERED.
