LEVINE Withdrawal of Petition for Rule Making Notice is hereby given thht the Nuclear Regulatory Commission has received a letter frcm Dr. Samuel H. Levine, Cellege of En~gineering, the Pennsylvania State University, withdrawing his petition for rule making PRM-73-4.

By letter dated February 2,1979, Dr. Levine filed with the Commission a petition for rule making to amenc its regulation " Physical Protection of Plants and Materials," 10 CFR Part 73.

The petitioner recuested that special nuclear material fuel in a fuel element which is not readily separable frcm other radioactive material and which has a tctal external rad.ation dose rate in excess of 0.4 rems per hcur per grar of U-235 at a distance of three feet be exempt frem the requirements of Part 73.

The petitioner also pr0 posed that the external dose rate requirement of 100 rems per hour at three feet in air be reduced to 10 rems per hour at three feet in air.

By letter dated August 30, 1979, the petitiener withdrew his petition for rule making PP.M-73-4 frcm further consideration by the Nuclear Regulatory Ccmmission anc' stated that

"...I uncerstand that the NRC staff and members of the rea ctor research cc= unity are investigating thie croblem and therefore there is no need to hold a formal hearing.

It is hcped that the efforts of the research reactor t

co= unity will be integrated into the final rules regarding this problem."

The Nuclear Regulatory Cc=ission intends to continue an evaluation of the radiation level needed for special nuclear material to be considered "self-crctecting."

Public cc ments en this matter are welccme even though the petition for rule making has been for. ally withdrawn.
