Gentlemen:

This refers to the investigation conducted by Messrs. J. E. Foster and

K. R. Ridgway of this office on September 11 and 12, 1979, into the

bypass of the forced circulation low flow safety trip circuit during

startup and for several shifts following criticality between September 7

and 9, 1979. This also refers to the special management meeting between

you and I and members of our respective staffs on October 18, 1979, in

which we reviewed Dairyland Power Cooperative's regulatory performance.

Enclosed are copies of the reports of the investigation and of the meeting.

Paring the investigation, certain of your activities appeared to be in

noncompliance with NRC requirements, as described in the enclosed Appendix A.

With respect to Item 1, the investigation and discussion with your staff

followi.> the investigation showed that actions as described in the

Immediate -tion Letter from this office, dated September 17, 1979, had

been taken to correct the identified noncompliance and to prevent recur-

rence.

Consequently, no reply to Item 1 is required. While the specific

item of noncompliance was corrected, we are concerned that management

controls were not effective in preventing this type of situation from

occurring. Thigconcernwasaddressedduringourmanagementmeeting

held on October 18, 1979.

Also in connection with the bypass of the forced circulation low flow

safety circuit, we are concerned that licensed operators failed to iden-

tify through six different shift changes the improper position of these

switches and the consequent reduction in reactor safety.

Noti.

No. 79-20, Rev. 1, issued on September 7, 1979, noted that the

NRC would more closely monitor the performance of NRC licensed individuals,

and would take appropriate enforcement action against such individuals

for significant violations of their license. After reviewing this event,

we have decided that no enforcement action will be taken against individual

operators. The relative aignificance of the event and the management's

responsibility to adequately train operators compared with operator's inde-

pendent actions (or lack thereof) were the factors which led to our decision.

However, we wish to point out that, while we expect licensee management to

assure chat adequate procedures and checklists are in place and that operators

receive adequate training, we also expect licensed operators to assess the

safety significance of their actions and to take corrective action, when

appropriate. We plan to review the actions of the LACBWR licensed operators

during future inspections.

Another matter of concern which we discussed during our management meeting

regarded the depletion of your technical staff.

In this regard we under-

stand you are expediting your efforts to fill vacancies in this area.

This notice is sent to you pursuant to the provisions of Section 2.201 of

the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 requires you to submit to this office within twenty days of

your receipt of this notice a written statement or explanation in reply,

including for each item of noncompliance:

(1) corrective action taken and

the results achieved; (2) corrective action to be taken to avoid further

noncompliance; and (3) the date when full compliance will be achieved.

Your written reply is required for Item 2 only.

In accordance with Section 2.790 of tbe NRC's " Rules of Fractice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and the

enclosed inspection report will be placed in the NRC's Public Document

Room, except as follows.

If this report contains information that you or

your contractors believe to be proprietary, you must apply in writing to

this office, within twenty days of your receipt of this letter, to with-

hold such information from public disclosure. The application must include

a full statement of the reasons for which the information is considered

proprietary, and should be prepared so that proprietary information iden-

tified in the application is contained in an aclosure to the application.
