Dear Harold:

I'm now finalizing a law review article which deals in part with the waste

. disposal issue, and with the Supreme Court's opinion in the Vermont Yankee case in particular. As I understand it, the D.C. Circuit has remanded the 60 the NRC, and rule making is ongoing. For use in my article, I would like the following information:

- The. approximate date on which a final rule is planned to be issued.

- A copy of the second supplement to NUREG-1248, i.e., NUREG-0216.

- In the DOE's recent EIS on waste disposal, it is stated that NRC declined to participate in preparation of the DOE doc'2 ment. If NRC has prepared its own trore recent statement on the environmental effects of nuclear waste disposal, I would very much appreciate receiving a copy. If documents relating to waste disposal have beer 1ssued in connection with the current rule making, those also would be of great interest.

- If a more recent version of Appendix A to ESRP 5.7, in Part III of NUREG-0158 has been prepared we would appreciate a copy. Our file copy is dated November 1977. If a final version of NUREG-0158 is now available, we would like that document in its enticaty.
