REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE Your letter of March 28, 1979, and its attacheC affidavit of Gould, Inco, orated, submitted for our review the qualification repc-t for the Gould 480 vc' mtor control centers. This included a supplemental report entitled " Accelerated Aging Procedure (CC-323.74-3A)," which Gould, Inc., requests to be withheld from public disclosure pursuant to Section 2.790 of 10 CFR Part 2.
Gould states in its affidavit that the information in the supplemental report consists of a method of demonstrating that aging does not lower the seismic withstandability of its equipment, and that unrestricted disclosure of this material is likely to cause substantial hann to its competitive position.
We have reviewed the application for withholding and the related supplemental report based upon the requirements and criteria of Section 2.790 of 10 CFR Part 2 and have concluded that they do not provide sufficient justification for us to find that the information should be withheld. We find that the supple-mental report contains no specific test results and does not reveal the specific capabilities or limitations of any specific equipment. Rether, the supplemental report provides a general outline of the order for the accelerated aging pro-cedure which will be followed on electromechanical devices removed from actual field use, as well as for new devices from stock, in order to qualify the devices to the equirements of IEEE Standard 323-1974. Such information is not of the type typically recognized by the NRC staff as being proprietary and does not satisfy the requirements of 10 CFR 2.790. Therefore, the request to wichhold tne supplementa.1 Gould reporc CC-323.74-3A is denied. Additionally, we find that the aff'...vit of Gould, Incorporated is not in conformity with the requirements of Section 2.790(b) of the Commission's regulations because it is conclusory in nature and does not address the considerations of paragraph (b)(4) with sufficient specificity to enable the Commission to have a basis for its determination under paragraph (b)(3)(i).
