Dear Mr. Sirico:
On June 1,1976, you filed a petition for rulemaking on behalf of the Public Interest Research Group, in which you requested the Comission to amend its regulations, " Reactor Site Criteria," 10 CFR Part 100, to set numerical limits on allowable population density around nuclear reactor sites.
Notice of the petition and a request for public com-ments was published in the Federal Register on June 29, 1976.
You were notified of this NRC action by letter dated July 6,1976. The public comment period ended Augus. 30, 1976, although comments continued to come in through September 1976. All comments recomended that the petition be denied.
In response to your letter of May 5,1977, we provided you with a status report in a June 2,1977, letter on three pending PIRG petitions for rulemaking, of which one was the subject petition (PRM-100-2).
The staff prepared an evaluation of the subject petition and provided recomendations to the Commission for consideration in a staff report dated December 4,1978, (SECY-78-624, copy attached). The staff met with the Commission on January 18, 1978, to discuss the staff's recomendations.
By memorandum dated February 15, 1979, from its Secretary to Lee V. Gossick, Executive Director for Operations (copy attached), the Commission deferred action on your petition until after review of a pending report from a Siting Policy Task Force.
This Task Force was established to review NRC staff siting policy and practices.
The Task Force's report is due for submission to the Commission on May 15,1979.
Following review of the Task Force report and new staff recomendations (as appropriate) on your petition, the Commission will determine the disposition of your petition.
