APPENDIX A NOTICE OF VIOLATION Philadelphia Electric Company Docket Nos. 50-352 50-353 Based on the results of the NRC inspection conducted on December 11-14, 1978, it appears that one of your activities was not conducted in full compliance with NRC regulations and the conditions of your NRC Construc-tion Permits CPPR-106 e d CPPR-107, as indicated below.

Section 3.F of Construction Permits CPPR-106 and CPPR-107 requires that, "Ali
- rk in connection with this project shall be carried on under the provisions of Permit 4671202, authorized by the Department of Environmental Resources, Comonwealth of Pennsylvania under the Act of June 25, 1913, as amended." Standard Condition 16 of Permit No. 4671202 requires that, "No untreated or ineffectively treated wastewaters shall at any time be discharged into the waters of the Comonwealth, and special care shall be used to prevent accidental
' spills' or similar unusual discharges of all raw, finished and waste materials."
Section 3.E.9 of Construction Permits CPPR-106 and CPPR-107 requires that, "The applicant shall take the necessary mitigating actions, including those summarized in Section 4.5 of the Final Environmental Statement, during construction of the Station and associated trans-mission lines to avoid unnecessary adverse environmental impacts from construction activities." Section 4.5.1.e of the Final En-vironmental Statement states that, "A settling basin has been con-structed in accordance with requirements of the water pollution and soil erosion control system required by the Department of Environ-mental Resources of the Commonwealth of Pennsylvania.... Only de-canted water from this basin will be discharged to the river."
Contrary to these requirements, on December 12, 1978, untreated (undecanted) wastewater pumped from within the cofferdam surrounding the intake structure was discharged directly into the Schuylkill River. Untreated wastewater was also pumped from the trench dug for placement of the cooling tower blowdown water diffuser, directly into Possum Hollow Run which flows into the Schuylkill River.
