Dear Mr. May:

This is in response to your letter dated January 9,1979, in which you requested, pursuant to the Freedom of Information Act, copies of any and all inquiries, past, present and future, made to the UStiRC (including F0IA requests) regarding the RWR-1 Radwaste Volume Reduction system as well as copies of all correspondence and information provided by the UStiRC in response to these inquiries.

Your request was received by the Office of Administration on January 11, 1979.

In your telephone conversation on January 29, 1979 and meeting on February 10, 1979 with Mr. Frank W. Karas of my staff, you agreed to bear the cost of reproducing the records subject to your request, which is $0.10 per page, as specified in 10 CFR 9.14(b), a copy of which is enclosed.

You also requested that our response include all internal fiRC documents regarding this subject, but exclude correspondence between flewport flews Industrial Corporation and the fiRC, or the i1RC's documents which are already in your possession.

Appendix A identifies F0IA requests which the fiRC has received regarding the subject matter of your request.

Copies of the requests, fiRC respon-ses, and documents disclosed to the requesters, are enclosed.

For your information, these documents are on file for public inspection and copying at the fiRC Public Document Room (fiRCPDR) located at 1717 H Street,fi.W., Washington, D.C.

Appendix B lists the internal fiRC memoranda, that are subject to your request, which are also enclosed.

The:c are also being placed in the fiRCPDR.

The documents enclosed comprise 493 pages.

Please send a check in the amount of $49.30, payable to "U.S. fluclear Regulatory Commission", along with a copy of this letter to the Director, Division of Rules and Records, Room MilBB-4210, U.S. fluclear Regulatory Commission, Washington, D.C.

o Portions of documents 25, 26, 27 and 33, listed on Appendix B, are drafts or other documents containing advice, opinions, and recommendations of the staff and are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 USC 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. Copies of documents 25, 26, 27, and 33 listed on Appendix B, with the exempt portions deleted, are being placed in the NRC PDR.

Pursuant to 10 CFR 9.9 of the Conmission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Muclear Reactor Regulation.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
