. (2) confirmed that the material will be subject to all the terms and conditions of the Agreement for Cooperation between the US and Taiwan; and (3) confirmed that Taiwan has adhered to the provisions of its Agreement for Cooperation.
The Executive Branch also forwarded an assurance letter from the Taiwan Government which contains the written physical security assurances required by 10 CFR 110.43(b).
The subject application is similar to prcposed license XSNM-1279 forwarded for Commission review on November 16,1978 (SECY-78-593). Staff comments on XSNM-1279 would apply to the application at hand.
Hcwever, recent developments in US-Taiwan relation-ships occurring since the receipt of the Executive Branch comments which bear on our cooperative arrangements with Taiwan must be taken into consideration.
The Department of State is, of course, in the process of clarifying the Executive Branch's position with respect to continued cooperation with Taiwan and the staff will be developing additional information on this matter as well.
In the meantime, to avoid unnecessary delay the subject application is forwarded for the Commission's information so that it may be consolidated with and be considered in the same context as the pending applications for Taiwan now before the Commission; namely, XUC9212 (SECY-75-570),
XR-ll3 (SECY-78-548, Confidential), XSNM01279 (SECY-78-593), and XU08393 (SECY-70-21).
The folicwing documents are pertinent to the subject application:
(1) Executive Branch views of December 14, 1978 recommending issuance (Appendix A), (2) application of June 27, 1978 (Appendix B), and (3) copy of a proposed license (Appendix C).
NMSS Technical NMSS has not received any information regarding the State Review:
System of Acc3unting and Control in Taiwan. Accordingly, NMSS is unable to make any determination regarding the capabilities of Taiwan's system to support the effective application of 1AEA safeguards.
In aadition, NMSS has not received any information concerning IAEA implementation activities and problems other than that included in the 1976 SSIR and the 1977 SIR documents. NMSS conclusions based upon this information are reflected in Table XIV of the memorandum to Commissioner Gilinsky dated November 29, 1978. Classified Appendix D (to be transmitted separately) provides a technical description of the basis for the conclusions in Table XIV and relates them to this particular export application. The main conclusion of the NMSS examinations is that the available information on IAEA implementation is not sufficient to permit NMSS to evaluate the effectiveness of IAEA safeguards in Taiwan.
With respect to physical security, NMSS has reviewed the program in Taiwan and found it adcquate for the purpose of this export.
Coordination:
NMSS views on the adequacy of the State's physical protection and material control and accounting programs and the effectiveness of IAEA safeguards implementation in Taiwan are as stated above. DELD has no lecal objection.

and conditions of the Agreement for Cooperation between the Government of the United States of America and the Government of the Republic of China concerning Civil Uses of Atomic Energy, which entered into fo ce on June 22, 1972, as amended on March 15, 1974.
This was confirmed in letters from the Embassy of the Republic of China to the Department of Energy dated August 11, 1978 and November 22, 1978, copies of which are enclosed.
The Republic of China has adhered to all provisions of its agreement with the United States.

Extent to Which Export Criteria Are Met A.
Section 127 Criteria As provided in Section 127 of the Atomic Energy Act, the following criteria govern exports for peaceful nuclear uses from the Un'.ted States of source material, special nu-clear material, production or utilization facilities, and any sensitive nuclear technology:
Criterion (1)
"IAEA safeguards as required by Article III (2) of the Treaty will be applied with respect to any such material or facilities proposed to be exported, to any such material or facilities previously exported and subject to the ap-plicable Agreement for Cooperation, and to any special nu-clear material used in or produced through the use thereof."
The Republic of China is a party to the Non-Prolifera-tion Treaty (SPT).
However, as a result of the Republic of China's expulsion from the IAEA in Decamber 1971, an NPT safeguards agreement has not been concluded between the IAEA and the Republic of China.
IAEA safeguards, essentially ccm-parable to those required under the NPT, are in effect en all nuclear material and facilities in the Republic of China under a trilateral US-IAEA-ROC safeguards agreement, pursuant to INFCIRC/66/Rev.
2, which entered into force on December 6, 1971.
Should the IAEA terminate the application of safe-guards in the Republic of China for any reason, the United States has the right to apply bilateral safeguards in lieu of IAEA safeguards pursuant to the Agreement for Cocpera-tion between the United States and the Republic cf China.
Therefore it is the Execative Branch view that cri-terion (1) is met.

SHEA NUCLEAR PEGULATORY COMMISSION Ene.ased is an Executive Brancb analysis covering a lic<.nse application for the export of low-e.riched uranium to the Republic of China.
In accordance with P.L.95-242, the analysis explicitly addresses how the requirements of Section 126 a.
(1) of the Atomic Energy Act are met, including the specific criteria cf Sections 127 and 128, as well as certafn additional factors, en-visaged by Section 126 a.
(1).
The Executive Branch, on the basis of its review cf this case, has concluded that the requirements of the Atomic Energy Act and P.L.95-242 have been met and that the proposed export would not be inimical to the common defensa and security of the United States.
- Moreover, the Republic of China has adhered to the provisions of its Agreement for Cooperation with the United States.
Therefore, the Executive Branch reccamends issuance of the requested export license.

As a Party to the NFT, the Republic of China is ccm-mitted not to develop or use nuclear explosive devices for any purpose.
Moreover, the ROC has prov:ced separate as-surances to the U.S.
in this regard.
Therefore, it is the Executive Branch view that eri-terion (2) is met.
4 Criterion (3_)
" Adequate physical security measures will be main-tained with respect to such material or facilities pro-posed to be exported and to any special nuclear material used in or produced through the use therecf.
Following the effective date of anv rec.ulations.nromulgated bv the Commission pursuant to Section 304(d) of the Nuclear Non-Proliferation Act of 1978, physical security measures shall be deemed adequate if such measures provide a level of protection equivalent to that required by the appli-cable reg;1ations."
The Executive Branch has assessed the physical security measures maintained by the Republic of China with respect to nuclear material and facilities and de-temined that they are adequate for the material covered by this license application.
The Embass.v of the Rec.ublic of China has.orovided by letter, a ccpy of which is enclosed, assurances that the material covered by this export request will be accorded physical protection consistent with INFCIRC/225/Rev 1.
Therefore it is the view of the Executive Branch that criterion (3) is met.

"No such material proposed to be exported and no special nuclear material produced through the use of such material will be reprocessed, and no irradiated fuel elements containing such material removed from a reactor shall ce altered in form or content, unless the prior approval cf the United States is obtained for such reprccessing or alteration.
Article VIII C.
of the U.S.-RCC Agreement for Co-oceration orovides that:
"When any sc.ecial nuclear material received frcm the United States of America pursuant to this Agreement or the superseded Agreement requires reprocessing cr any irradiated fuel elements containing fuel material received frca t h e. United States of America pursuan'. to this Agreement or the superseded Agreement are to be rencved frcm a reactor and are to be altered in forr or content, such reprocessing cr alteration shall be performed ir facilities acceptable to both parties upon a joint determina icn that the

As no joint determination under Article VIII C.
can be made without the agreement of the "nited States, and since the facilities to be used must be acceptable to the U.S.
as one of the Parties, it is the view of the Executive Branch that criterion (5) is met.
Criterion (6)
"No such sensitive nuclear technology shall be ex-ported unless the foregoing condition chall be applied to any nuclear material or equipment which is produced or constructed under the jurisdiction of the recipient nation or group of nations by or through the use of any such exported sensitive nuclear technology."
The proposed export does not involve the transfer of sensitive nuclear technology.
Criterion (6) is, therefore, not applicable.

The export of 4,500 kilo-grams of U-23 5 contained in 239,000 kilograms of uranium in the form of fuel elements containing uranium dioxide enriched to.a maximum of 4.0 percent U-235 Applicant:

June 27, 1978 Purpose of Export This enriched uranium dioxide in the form of fabri-cated fuel elements will be shipped to the General Electric Technical Services Company Incorporated in Taiwan for the initial cores of the Kuosheng nuclear power reactor, units one and two.
An extra margin of 5 percent has been included in the quantity of material requested for contingencies.
The Kuosheng Units 1 and 2 are 951 megawatt electric boilinv water reactors supplied by GE.
Located near Kuosheng town, the reactors are owned and will be operated by the Taiwan Power Company.
Unit 1 is scheduled to begin commercial operation in October 1981; Unit 2 in October 1982.
Shipments of the fuel material are scheduled to begin July 1, 1979 and end December 1, 1981.
