AFFIDAVIT OF HARLEY SILVER I, Harley Silver, being duly swcrn and deposed, hereby state that:

1.

I am employed by the U. S. Nuclear Regulatory Ccmission as a Project Manager in the Division of Project Management.

Among my responsibili-ties is the management of the NRC Staff's safety evaluation of the proposed restart of Three Mile Island Unit No. 1 (TMI-1).

The purpose of this affidavit is to address the consideration of Class 9 accidents for the proposed restart of TMI-1.

The Staff is continuing its evaluation of the TMI-2 accident and those scenarios which are clear and close analogs to the accident and which are specified in Contention No. 17 of Steven C. Sholly and Contention No. 4(b) of ECNP, or which the Licensing Board may accept as part of

939 009 8 002110 b b UCS Contention No. 13. However, based on our review to date of the TMI-2 accident and of the design and operation of TMI-1, we have imposed various requirements on the design and operation of TMI-1.

As a result of our continuing evaluation, we expect to be able to deter-mine whether additional requiremer.ts should be imposed, so that, together with those requirements already irposed, such scenarios would not repre-sent credible accident sequences at TMI-1.

On the bases of (1) the Staff's evaluation of the design of the TMI-1 facility, (2) the Staff's evaluation to date of the Three Mile Island Unit 2 (TMI-2) accident, and (3) the additional requirements that the Staff has imposed and may be expected to impose in the future on TMI-1 ts a result of its evaluation of the Three Mile Island accident, there are no novel features or special circumstances associated with the design of TMI-1 that would distinguish it from other land-based light water reactor plants to the extent that consideration of Class 9 accidents is warranted under present policy, except as discussed in paragraph 3 above.
