Dear Mr. Denton:

In regard to Mr. R. L. Baer's letter of December 11, 1979 discussing the expe-rience requirements and location of the individual responsible for the radia-tion protection program at McGuire Nuclear Station, note that this issue was previously resolved at Duke Power Company's Oconee Nuclear Station, Docket Nos.

50-269, -270, -287 by Amendment Nos. 77, 77, and 74 for License Nos. DPR-38, DPR-47 and DPR-55 for Unit Nos. 1, 2 and 3.

Reference Attachment i for a copy of these amendments.

Therefore, this letter is to advise you that the wording as set forth in Sec-tion 6.1.1.4 of the Oconee Nuclear Station Technical Specifications (reference attached amendment) shall be adopted for use at McGuire Nuclear Station.

In regard to the location of the Station Health Physicist, this individual shall be located onsite.

The Comission has issued the enclosed Amendments Nos. 77, 77, and 74 for Licenses Nos. DPR-38, OPR-47 and OPR-55 for the Oconee Nuclear Station, Units Nos.1, 2 and 3.

These amendments consist of changes to the Station's ccmon Technical Specificatiens and are in response to your request dated March 21, 1979.

These amendments revise the Technical Specifications ::y ucgrading the auali-fications of the Site Health Physicist (Radiation Protection Manager).

Cocies of the Safety Evaluation and the Notice of Issuance are also enclosed.

Amendment No. 77 License No. OPR-38 1.

The Nuclear Regulatory Comission (the Comission) has found that:

The application for amendment by Duke Power Company (the licensee) dated March 21, 1979, complies with the standards and requirements of tha Atomic Energy Act of 1954, as amended (the Act), and the Cormiission's rules and regulations set forth in 10 CFR Chapter I; N

B.

The facility will operate in confomity with the application, the pmvisions of the Act, and the rules and regulations of the Comission; C.

There is re6sonable assurance (1) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in cormliance with the Comission's regulations; D.

The issuance of this amendment will not be inimical to the comen defense and security or to the health and safety cf the public; and E.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Comission's regulations and all applicable requirements have been satisfied.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING AMENCMENT NO. 77 TO FACILITY OPERATING LICENSE NO. OPR-38 AMEN 0 MENT NO. 77 TO FACILITY OPERATING LICENSE NO. DPR 47 AMENOMENT NO. 74 TO FACILITY OPERATING LICENSE NO. DPR-55 DUKE POWER COMPANY OCONEE NUCLEAR STATION, UNITS NOS.1, 2 AND 3 DOCKETS NOS. ' 50-269, 50-270 AND 50-287 Introduction By letter dated March 21, 1979, Duke Power Company (the licensee) requested a change 'a the Oconee Nuclear Station, Units Nos.1, 2 and 3, Technical Specifications (TS).

This change would upgrade the qualifications of the Site Health Physicist.

Evaluation The proposed change to TS 6.1.1.4, which delineates minimum requirements for the cosition of Site Health Physicist, upgrades tne requirenents in regard to requiring a bachelor's degree in science or engineering or the equivalent in experience, need for formal training in radiation protection and at least five years of applicable professional experience. We have d:ompared the precosed qualifications with NRC Regulatory Guide 1.8, " Personnel Selection and Training" and find them comparaole.

We conclude that the changes conform to the Regulatory position of Regulatory Guide 1.3 and are thus acceptable.

2-n Conclusion We have concluded, based on the censiderations discussed above, tnat:

(1) because the amendments do not involve a significant increase in the probability or consequences of accidents previously considered and do not involve a significant decrease in a safety margin, the amendmen ts do not involve a significant hacards consideration. (2) there is reasonable assurance that the health and safe?.y of the public will not be endangered by operation in the proposed mainer, and (3) such activities will be conducted in compliance with '.he Commissien's regulations and the issuance of thest amendments will not be inimical to the common defense and security or to the health and safety of the public.
