With your application dated July 13, 1979, which was filed with the Office of Nuclear Reactor Regulation (OriRR), you paid a Class IV amendment fee of $12,300. The application proposed seven items relating to the Technical Specifications for the Davis-3 esse Nuclear Power Station Unit No.1.
Based on guidance from the 0:lRR staff as a result of their prelininary review of your July 13 application, it has been detemined that items 1 through 5 of your application are in response to a Commission Order dated May 16, 1979, and as such are not subject to the fee orovisions of 10 CFR 170.22.
It is our understanding that item 6 is only a Technical Specification basis change associated with item 3 of your application. The remaining item (item 7 on Safety Feature Actuation System) is subject to fees and has been detemined to be a single safety issue requiring a Class III fee of 34,000. Therefore, your Company is entitled to a refund of $3,300.
