OCT 191979 APPENDIX A NOTICE OF VIOLATION Babcock and Wilcox Company License No. SNM-778 Lynchburg Research Center Based on the NRC inspection September 10-14, 1979, certain of your activities were apparently not conducted in full compliance with NRC requirements as indi-cated below.
These items have been categorized as described in correspondence to you dated December 31, 1974.
As required by 10 CFR 20.103(c) a licensee may make allowance for the use of respiratory protective equipment in estimating exposure of individuals to airborne radioactive material provided that such equipment is used as stipulated in Regulatory Guide 8.15, " Acceptable Programs for Respiratory Protection." Regulatory Guide 8.15 in Paragraph C.2 requires the equipment be used so that the average concentration of radioactive material in the air that is inhaled during any period of uninterrupted use in an airborne radioactivity area, on any day, by any individual using the equipment, will not exceed the values specified in Table 1, Column 1 of Appendix B to 10 CFR 20.
Contrary to the above, on February 5, 1979 three individuals entered Cell #1 and used respiratory protective equipment in a manner such that the average concentration of radioactive material in the air inhaled exceeded the values specified in Table 1, Column 1 of Appendix B to 10 CFR 20; this is attested to by the 11.1 MPC-Hrs. received by the individuals in less than 30 minutes.
This is an infraction.
