AGREEMENT Pursuant to Section 2.759 of the Commission's Rules of Practice, for the purpose of resolving concerns of Lakeshore Citizens for Safe Energy and Safe Haven, Ltd. ("Intervenors")
relating to the above-captioned proceeding before the U. S.
Nuclear Regulatory Commission ("NRC") for the expansion of the spent fuel pool storage capacity at the Kewaunee Nuclear Plant, for and in consideration of the mutual agreements contained herein, Wisconsin Public Service Corporation ("WPSC")
the NRC Regulatory Staff, and Intervenors stipulate and agree as follows:
1.
Intervenors agree to withdraw as parties to the above-described proceeding, and shall take all reasonable steps to secure the termination of said proceeding, including the filing of, or joinder in, appropriate actions before the Atomic S,afety and Licensing Board to secure said withdrawal 7 90313 0 5r/f;

2.
WPSC will provide Intervenors with each "Seni-annual Effluent Release Report" and " Annual Reporting Re-quirements Report" which is submitted to the NRC during the term of this Agreement.
Said reports will include the following if still required by the NRC for nuclear power plants:
a.
A listing by nuclide of radioactive airborne effluents released from Kewaunee Nuclear Plant; b.
A comparison of the airborne effluent releases with quantities equivalent to design objectives of Appendix I to 10 CFR Part 50 set forth in the Kewaunee Power Plant Technical Specifications; c.
Occupational exposures at Kewaunee Nuclear Plant; d.
The results of radioactivity analyses of ground-water samples obtained from the Kewaunee Nuclear Plant wells; e.
The results of radioactivity analyses of water samples obtained from Lake Michigan; f.
The results of radioactivity analyses of water samples obtained from the Kewaunee Nuclear Plant site drainage system.

During the term of this Agreement, WPSC will
provide Intervenors aith copies of any Licensee Event Report concerning operation of the spent fuel pool as are submitted to the NRC.
It is agreed and understood that the Licensee Event Reports to be furnished as stated above include, among other possible events, any report concerning the integrity of spent teci rods or cladding.

WPSC currently contracts for, and intends to continue contracting for, the removal and disposal of low-level radioactive wastes at authorized low-level waste disposal facilities located off-site.
With the exception of decom-missioning alternatives considered during the licensing review of the Kewaunee Nuc1 car Power Plant, WPSC has not intended and does not intend to seek approval from the NRC permanently to dispose of low-level wastes at the Kewaunee Nuclear Plant site.

WPSC has never intended and coes not intend the Kewaunee site to become a permanent repository for spent fuel.
WPSC is actively seek,ing, and intends to continue to actively seek, arrangements for ultimate off-site disposition of spent fuel assemblies.

The information designated above for delivery to Intervenors will be provided to the following person on behalf of both intervenor groups: _
Joan Estes 3314 Cass Lake Road Manitowoc, Wisconsin 54220 Intervenors will jointly notify WPSC if they wish to sub-stitute a different agent for receipt of the information.
7.
In the event of any questions by the Intervenors concerning the operation of this Agreemant, they may contact the following employee of WPSC:

This Agreement shall be filed with the Licensing Board nd shall become. effective upon the entry of the order or orders sought by the motions referred to in Paragraph 1.
This Agreement shall remain in effect for so long as the Kewaunee Nuclear Plant shall be licensed by the NRC for operation, or until such earlier date when Intervenors may have disbanded or otherwise ceased to exist.
Intervenors shall notify WPSC prior to the time they disband or otherwise cease to exist.
In addition, to assure the continued interest of Intervenors in. receiving the above information, WPSC will on an annual basis send a certified letter return receipt requested to the Intervenors inquiring whether continued receipt of information is desired.
Non-response within 30 days to any such letter will be deemed to
