UNITED STATES NUCLEAR REGULATORY COMMISSION Coe C od R y.

WASHINGTON, D. C. 20555 3 i, j

January 26, 1979

CFFICE OF THE CHAIRMAN

[

The Honorable Morris K. Udall, Chairman Subcommittee on Energy and the Environment Comittee on Interior and Insular Affairs United States House of Representatives Washington, DC 20515

Dear Mr. Chainnan:

As you may know, the Nuclear R.egulatory Commissiori is required, pursuant to Section 1701 of the Atomic Energy Act of 1954, as amended, to report annually to Congress on indemnity operations over which the Commission has jurisdiction. The NRC, or its predecessor the AEC, has prepared ano submitted to Congress such indemnity operations reports on or about April 1 of every year since 1958.

In addition, NRC includes very similar information on indemnity operations in its Annual Report to Congress prepared pursuant to Section 307(c) of the Energy Reorganization Act of 1974.

The NRC is consiidering eliminating the preparation and submittal to Congress of the annual indemnity operations reports as separate reports.

Rather, the NRC proposes to include all information contained in the indemnity operatiens reports in its. Annual Report to Congress.

Wa p

believe that inclusion of such information in the Annua'i Report to i

Congress fulfills the statutory requirements of Section 1701 and elimi-nates the duplication of information resulting from the present method

)

of reporting.

l If your committee wishes to continue to receive separate annual reports I

on indemnity operations, please so inform us.

Sincerely, os ph M. Hendrie k
