Dear Congressman Lagomarsino:
Your letter of November 22, 1978, to Secretary Schlesinger, Department of Energy (DOE), transmitting an inquiry by Gary Burns on who inspects structural steel at Diablo Canyon, has been forwarded to this office for response.
The Nuclear Regulatory Cormission (NRC) has the responsibility within the Federal Government for licensing and regulating the construction and operation of licensed nuclear power plants.
The DOE does not have responsibility for licansed nuclear power plants; however, DOE does have the responsibility for the operation of a number of Federally owned nuclear experimental and production facilities.
In discharging its responsibility the NRC requires each licensee to establish a formalized quality assurance program for the control of all phases of nuclear power plant construction and operation relating to s a fety.
The quality assurance program for licensed reactors under construction, such as Diablo Canyon, includes inspection and audit of construction activities by the licensee and his contractors.
Thus, the licensee, Pacific Gas and Electric Company (PG&E), has responsibility for the first several tiers of inspection and audit.
The NRC performs overview inspection to verify that the licensee has developed and implemented an effective quality assurance program and is carrying out his required responsibilities.
NRC inspection then is at the top of a tiered inspection system which can be represented as a pyramid.
For Diablo Canyon, the NRC field office which has this overview responsibility is:
