Dieterich, being duly sworn according to law, deposes and says as follows:

1.

I am a Senior Nuclear Engineer in the Genera-tion Engineering Department of the Sacramento Municipal Utility District (Licensee) and give this affidavit in support of Licensee's Motion for Summary Disposition of Contention No. 5-2 of California Energy Commission.

I have personal knowledge of the matters set forth herein, and believe them to be true and correct.

A summary of my professional quali-fications and experience is attached to my affidavit in sup-port of Licensee's Motion for Summary Disposition of Contentions by Intervenors Gary Hursh and Richard Castro, filed simul-taneously herewith.

I am familiar with Contention No. 5-2 of the California Energy Commission (CEC) suggesting the need for a controlled filtered venting system to provide over-pressurization protection for the containment, as well as with CEC's responses to interrogatories served by parties with respect to that contention.

I have also reviewed the portions of NUREG-0 5 8 5 (TMI-2 Lessons Learned Task Force Final Report) and of the document entitled " Underground Siting of Nuclear Power Reactors:

An Option For California" referred to by CEC in support of that cont;ntion.

As describe #

in those pleadings and documents, the function of the controlled filtered venting system pro-posed by CEC would be to prevent or delay containment failure in the event of an accident involving core melt or a loss-of-coolant accident more severe than a break equivalent in size to the double-ended rupture of the largest pipe of the reactor coolant system.

Rancho Seco has a containment and related engineered safeguards,to control the containment atmosphere following postulated accidents,which conform to all applicable requirements of the NRC's General Design Criteria For Nuclear Power Plants (10 CFR 50, Appendix A).

Rancho Seco does not have a controlled filtered venting system such as is proposed by CEC.

Such a system for Rancho Seco would not be required to achieve conformance with any existing regulatory requirement.

The controlled filtered venting system identified by the California Energy Com:nission (in inter-rogatory answars) and generally described in " Underground Siting of Nuclear Power Reactors:

An Option For California,"

utilizes a passive system, incorporating a rupture disc, to prevent containment failure by relieving the containment pressure before the design pressure is reached and therefore conflicts with General Design Criteria 16 and 50 of Appendix A to 10 CFR 50.

A controlled fil'tered venting system as pro-posed by CEC is not commercially available.

To the best of my knowledge, such a system has not been developed, and there has been no demonstration of the effectiveness, reliability or safety of such a system.
