LICENSEE'S MOTION FOR
SUMMARY
DISPOSITION OF CONTENTIONS BY INTERVENORS GARY HURSH AND RICHARD CASTRO Pursuant to S 2.749 of the Commission's Rules of Practice (10 C.F.R. S 2.749), Licensee moves the Atomic Safety and Licensing Board for summary disposition in Licensee's favor of all the Contentions advanced by intervenors Gary Hursh and Richard Castro.
As grounds for its Motion, Licensee asserts that there is no genuine issue of material fact to be heard with respect of any of those Contentions, and that Licensee is entitled to a decision in its favor an each Contention as a matter of law.
This Motion is supported by the Licensee's Statement of Material Facts As To Which There Is No Genuine Issue To Be Heard (Hursh-Castro Contentions), Licensee's Brief In Support Of Motion For Summary Disposition Of Contentions By Intervenors Gary Hursh And Richard Castro, and the Affidavits of Robert A.
