On December 28, 1979, Intervenor New England Coalition on Nuclear Pollution (NECNP) filed a response to the Staff's opposition to its petition for review in the present proceeding. Thereafter, by letter dated January 2, 1980, counsel for NECNP advised the Commission that it had filed its December 28, 1979 response prior to reviewing the prohibition upon such filings contained in 10 CFR 62.786, and thus the Commission could disregard its pleading.
In view of counsel's representation, the Staff will not seek leave to reply to NECNP's submission.
