SUMMARY

OF KEY EVENTS WEEK ENDING JANUARY il,1980 Millstone 1 An anonymous telephone call to I&E on January 8,1980, resulted in Northeast Nuclear Energy Company eliminating (administratively) the

" emergency" isolation condenser capability, i.e., declaring it inoperable.

The concern that prompted this action involves surface cracks in the concrete at the location of the semisic restraint plate bolts outside containment for the steam line to the isolation condenser.

Currently approved Tech Specs allow the plant to continue operation with the isola-tion condenser inoperable for 15 days provided suitable compensatory measures are taken.

NNECo plans to propose a Tech Spec change which would permit indefinite operation at power levels below 40% whenever the isolation condenser is inoperable.

Browns Ferry 1, 2 and 3 Chem-Nuclear notified TVA (and apparently other utilities that ship radioactive waste material to Barnwell) that as a result of restrictions imposed by the State of South Carolina, they had to impose a gradually decreasing allotment on the amount of material that could be shipped to the disposal site. On January 3,1980, the Chairman of the Board of TVA issued a news release stating that TVA was taking action to provide the capablity of storing low level wastes on site.

Emergency. Planning Regional workshops with State / local officials a. ' utility representatives on proposed regulations upgrading emergency planning requirements in areas near nuclear power plants are planned for several locations during January.

In response to widespread interest, each meeting will now include an additional evening session for receipt of public comments.

Uravan Uranium Mill In response to recommendations from the Uranium Recovery Licensing Branch, the State of Colorado issued an order on January 4, 1980, to the Union Carbide Corporation to cease discharge into tailings pond Number 3 until remedial actions to stabilize the embankment are completed. This order follows a similar ordei in December of 1979 regarding pond Number 2.

Technical Assistance Reouest from Texas The Texas Department of Health has requested NRC technical assistance on a uranium recovery project proposed by the Anaconda Cooper Company to be located in the state of Texas. Anaconda has requested review of a tailings disposal plan that would allow private ownership of the land to continue.

The staff has also been requested to make a determination as to whether near surface burial of tailings back in the mine from which the ore was removed can be approved without ownership of the land to enable title transfer at the termination of operations.

Regional Workshops with State / local officials and utility representatives on proposed regulations upgrading emergency planning requirements in areas near nuclear power plants will be. held in New York City on January 15, San Francisco on January 17, Chicago on January 22, and in Atlanta on January 24.

In response to widespread interest, each meeting will now include 61 additional evening session for receipt of public comments.

Great intee sst for public participation has been expressed for the New York and San Fra.'cisco meetings.

Each session cill have presentations in the morning on the proposed rule, criteria for concurrence, role of FEMA, and role of Public Affairs.

Each afternoon session will be a discussion by invited participants on the various aspects of the proposed requirements.

Don Hopkins, Transportation and Product Standards Branch,is assisting NMSS and Region V in monitoring radioactive waste shipments received at the Richland low level waste burial site.

Mr. Hopkins tour of duty at Richland is January 7 through January 18.

On January 8,1980 Don Nellis and Ralph Jones participated in the first meeting of the Task Force on Emergency Planning for Transportation Accidents Involving Radioactive Materials.

The meeting was chaired by Don Collins of SP and Wendell Carriker of DOT.

Representatives from several state organizations, FEMA, EPA, Sandia Labs, and other NRC offices were in attendance.

The general scope of the problem was discussed along with the approach to be taken in meeting the task force objectives.

Attendees were asked to submit suggestions for areas that needed improvement in present guidance.

SD representatives provided some suggestions resulting from previous and present SD efforts in this area.

This guide provides guidance acceptable to the NRC staff on the use of personnel neutron dosimeters. The guide supplements ANSI N319-1976 by adding an accuracy requirement.

Revision 2, on the bases of recent research, advises that power reactor licensees should not use NTA film to monitor neutrons.

The N/r ratio may be used only when prior surveys warrant.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending January 11, 1980 Application for LWR Fuel Fabrication Facility, Prattsville, Alabama An application and an environmental report have been received from Westinghouse Electric Company for their new light water reactor fuel fabrication facility in Prettsville, Alabama. Westinghouse has expressed a desire to start breaking ground for this facility in early CY-1981 and to start operation in mid-CY-1983. Westinghouse has informed us that eventually this facility will have a capacity comparable to the facility at Columbia, South Carolina.

General Electric, Wilmington, North Carolina Applications for two major amendments have been received from General Electric Company, Wilmington, North Carolina. One is to operate and use an incinerator for processing combustible waste, and the second is to authorize the con-struction and use of several new UO2 conversion lines.

These new lines will use the GEC0 process. This is a dry process developed by GE which converts UF6 directly to UO2 in a hydrogen flame.

This expansion will allow GE to shut down their wet ADU lines.

Public Meeting Re.

Atomics International, Canoga Park, California On January 22, 1980, a public informational meeting will be held in Ventura County, California, before the Ventura County Supervisors to discuss the activities involving radioactive materials at Atomics International in Canogea Park, California.

These activities are licensed by NRC under Special Nuclear Material License No. SNM-21 and include the fabrication of highly enriched fuel elements for research reactors, a small plutonium R&D laboratory and a hot-cell.

The meeting was precipitated by a group known as "Stop Uranium Now" (SUN).

Specific concerns are centered around the types of radioactive materials licensed, and potential risk posed to public health and safety; regulatory activities for insuring public safety in transporting of radioactive materials to and from the site; requirements for offsite environmental monitoring; health hazards created by decontami-nating and decommissioning; and requirements for emergency response plan.

Region V has been requested to participate.

Meeting with the Assistant Attorney General, State of Illinois Representatives of the Fuel Cycle Division, ELD and Region III met with the Assistant Attorney General, State of Illinois on January 3,1980.

The purpose of the meeting was to discuss the concerns regarding the operations of a radioactive waste collector which is an NRC licensee located in the State of Illinois.

The basic concerns were raised by members of the Attorney General's staff during a recent inspection and dealt with emergency planning and fire p rotection.

NRC agreed to look into those areas of concern and report back to the Attorney General's office.

Meetina Sponsored by the American Collece of Radiology and the Medical

_ School of University of New Mexico Members of the Division of Fuel Cycle and Material Safety attended a meeting of the nuclear medicine communities ad hoc group on the NRC medical ALARA pro gram. The current philosophy of standard bodies (NCRP, ICRP, UNSCEAR and BEIR III) instrumental in establishment of personnel radiation exposure limits was presented. There were no agreements reached at the meeting. However, the ad hoc group plans to convene a small working group within a week to formulate counter proposals meant to fully meet NRC objectives without, or with modified revisions of, those features they considered objectionable.

MC&A Upgrade Rule Development A preliminary draft of the basic structure of the MC&A Upgrade Rule has been prepared and was submitted for initial staff review on January 9,1980.

Interim Physical protection of Irradiated Reactor Fuel in Transit The Interim Physical Protection of Irradiated Reactor Fuel in Transit Rule, and the associated Statement of Considerations, will be circulated for staff review and comment the week of January 14, 1980. Some major changes in the rule relate to policy on through-city transits, definition of heavily populated area, requirements for shipments by boat, and specification of minimum spent fuel quantities subject to the regulation.

Items of Interest 3

Uravan Uranium Mill In response to recommendations from the Uranium Recovery Licensing Branch, the State of Colorado issued an order on January 4,1980, to the Union Carbide Corporation to cease discharge into tailings pond Number 3 until remedial actions to stabilize the embankment are completed.

This order follows a similar order in December of 1979 regarding pond Number 2.

These actions have resulted in a total mill shutdown.

Union Carbide is currently presenting information to the State which they hope will allow discharge into previously used pond Number 1.

Research and Development In-Situ Extraction License Issued to Teton The U.S. Nuclear Regulatory Commission has issued a Source Material and Byproduct Material License to Teton Exploration Company for their research and development in-situ extraction project.

The license area, known as the Leuenberger Site, is located in Converse County, Wyoming, approximately thirty (30) air miles east of Casper.

Objectives of the project are to determine the economic feasibility of ore extraction at the Leuenberger Site and development of operating and environmental parameters for future commercial scale operations.

Techical Assistance Request from Texas The Texas Department of Health has requested NRC technical assistance on a uranium recovery project proposed by the Anaconda Copper Company to be located in the state of Texas.

Anaconda has requested review of a tailings disposal plan that would allow private ownership of the land to continue.

The proposal involves disposal of tailings back in an o. pen-pit surface mine with approximately 60 feet of overburden.

The NRC staff has taken the preliminary position in the Generic Environmental Impact Statement (GEIS) that Government land ownership will probably be required except possibly in the case of deep mine disposal.

The staff has been requested to make a determination as to whether near surface burial of tailings back in the mine from which the ore was removed can be approved without ownership of the land to enable title transfer at the termination of operations.

Meetino with NRDC re 10 CFR Part 60 On January 7,1980, members of the NRC staff met with Messrs Cochran and Tamplin of NRDC to discuss the draft technical requirements for geologic disposal of high-level wastes (10 CFR Part 60).

They strongly supported the multi-barrier approach and the requirement that the repository design permits the waste to be retrieved throughout the operational period and for 50 years afterward.

They argued for incorporating numerical criteria in the technical rule.

They agreed with the requirements of the procedural rule for characterizing alternative haste forms and alternative sites in di#ferent geologic media.

They also agreed with the four-stage licensing process contained in the proposed licensing procedures.

They suggested that we should consider licensing the waste form separately.

OFFICE OF INSPECTION AND ENFORCEMENT Items of Interest Week Ending January 11, 1980 1.

The following Notifications of Significant Enforcement Action were dis-patched during the past week:

a.

EN-79-05A United Nuclear Corporation, Wood River Junction, Rhode Islani On January 9,1980, an Order Imposing Civil Monetary Penalties in the amount of $11,250 was issued to the subject licensee.

Previously, on July 16,1979, a Notice of Proposed Imposition of Civil Penalties in the amount of $15,750 was issued based on noncompliance items related to physical security and material control and accounting.

After con-sideration of the licensee's response, the IE staff concluded that the penalty for one item should be remitted in its entirety and the penalty for another item should be mitigated.

b.

EN-79-11A Diagnostic Isotopes, Inc., Bloomfield, NJ - On October 15, 1979, a Notice of Proposed Imposition of Civil Penalties in the amount of $8,000 was issued to the subject licensee.

In our letter to the licensee, we re-feried to a potential item of noncompliance pertaining to the obtaining of reports by Diagnostic Isotopes from its customers who receive technetium-99m eluate.

This matter has now been clarified in discussions with the U.S.

Food and Drug Administration and it has been determined that the matter is an alleged item of noncompliance.

Consequently, an additional Notice of Violation and an additional Notice of Proposed Imposition of Civil Penalty in the amount of $500 was issued on January 10, 1980. Also, additional information has been requested from the licensee to supplement his response to the October 15, 1979 Notice of Violation.

c.

EN-80-01 Eastern Testing and Inspection, Inc., Pennsauken, N.J.

A Notice of Violation and a Notice of Proposed Imposition of Civil Penalties in the amount of $8,400 were issued to the subject licensee on January 7,1980.

This action was based on six alleged items of noncompliance relating to loss of radioactive source and exposure of an individual.

OFFICE OF THE EXECUTIVE LEGAL DIRECTOR ITEMS OF INTEREST WEEK ENDING JANUARY 11, 1980 La Crosse Boiling Water Reactor On Jdnuary 10, 1980, the Licensing Board appointed to the LACBWR (La Crosse) spent fuel pool license amendment proceeding issued its Initial Decision approving the spent fuel pool modification and finding a 3 year need for power from the LACBWR facility.

In its decision, the Board referred to the Appeal Board the question of jurisdiction of the Licensing Board to raise sua sponte and order a hearing on the need for power from LACBWR until the SEP review of the plant is complete. The need for power hearing was held in October,1979, as the sole issue litigated in the SFP proceeding since the Licensing Board had previously granted summary disposition of all contentions of the Intervenors.

0FFICE OF INTERNATIONAL PROGRAMS WEEK ENDING JANUARY 11, 1980 INTERNATIONAL COOPERATION Technical Assistance Farouk Eltawila, Cnntainment Systems Branch, will travel to Mexico the week of January 14, to advise the Mexican Regulatory Authority (CNEN) on the containment for the Laguna Verde Reactor.

This is a first step visit that will be followed by a one-month IAEA safety mission to Mexico on containment later in 1980.

Foreion Visit On Thursday, Ms. Emma Bonino, a Member of the Italian National Parliament in Strasbourg, met with J. D. Lafleur, IP and J. A. Norris of DSE, to discuss the procedures for the siting of nuclear plants in the U.S. and the role of local authorities in the siting process.
