- Gentlemen:

On December 19, 1978, Public Service Electric and Gas Co. withdrew the construction permit application for Atlantic 1 and 2 (Amendment 33 to the Preliminary Safety Analysis Report for Atlantic Generating Station, Units 1 & 2).

Under 10 CFR Part 170 it is Comission practice to recover review costs using the procedures of Footnote 3 to 10 CFR 170.21 when the review of the project is complete. The review of this project was completed as of March 16,1979. Accordingly, we have determined the actual expenditures incurred for professional manpower and contractual support services from the date the application was filed to its date of withdrawal. Actual costs for Unit 1 were $1,236,400 and $7,100 for Unit 2.

Under the Comission's regulations, we limit the charge for review to that which would be applied to the contruction permit under 10 CFR 170.21 A.5.c.,

that is, $855,000 for Unit 1 and $7,100 for Unit 2.

$125,000 has already been paid as an application fee. The balance due for the review of the contruction permit application is as follows:

Unit 1 Maximum fee $855,000 Unit 2 7,100 Subtotal

$862,100 Less application fee -125,000 Balance Due NRC

$737,100 We have notified our Office of Controller to issue an invoice to Public Service to cover the Commission's review costs.
