the Committee on Merchant Marine and Fisheries lj A BILL To authorize the Secretary of Commerce to charter the nuclear ship Savannah to Patriots Point Development Authority, an agency of the State of South Carolina.
1 Be it enacted by ths Senate and House of Representa-2 tices of the United States of America in Congress assembled, l-3 That the Secretary of Commerce is authorized within one

4 year after enactment of this Act, to charter the nuclear ship 5 Savannah to Patriots Point Development Authority, without 6 monetary consideration, for a minimum of five years and a 7 maximum of thirty years, with options to renew for five-year 1692 028 e
2 1 periods thereafter, for use as a museum ship and for other 2 public purposes, but not for transportation, together with 3 such of her fixtures, tackle, apparel, furnishings, and equip-4 ment as the Secretary of Commerce, in the Secretary's dis-5 cretion, determines.
6 SEC. 2. The charter authorized by section 1 shall in-7 clude a provision that-1.
8 (a) the Secretary of Commerce shall be responsi-

ble for inspection and maintenance of the hull below 10 the waterline and that Patriots Point Development Au-11 thority shall be responsible for all other maintenance, t
12 including the paying for the electrical power for the ca-t I-13 thodic hull protection system; i

14 (b) the Patriots Point Development Authority
[r 15 shall save the United States harmless from all liability I(
16 with respect to the vessel;

17 (c) the Patriots Point Development Authority 18 shall return the vessel to the Secretary of Commerce 19 at the termination of the charter or any renewal there-

20 of in the same condition, fair wear and tear excepted, 21 as when the charter was entered into; and 22 (d) the Patriots Point Development Authority 23 shall obtain such insurance and provide such other as-24 surances as the Secretary of Commerce may require to 25 carry out its obligations under this Act.

SEc. 3. The Secretary of Commerce, acting for the 2 United States Government as owner of the vessel, and Patri-3 ots Point Development Authority shall apply to the Nuclear 4 Regulatory Commission for a license to possess but not to

5 operate the nuclear utilization facility under which the sole 6 liability of the Secretary of Commerce shall be that the Sec-7 retary will bear the financial responsibility for the ultimate 8 disposal of the reactor and other nuclear systems and radio-9 active contaminated components in the vessel in accordance 10 with a plan which the Secretary of Commerce will submit at 11 the time the reactor, nuclear systems, and radioactive compo-f 12 nents are to be disposed of and which is then approved by the 13 Nuclear Regulatory Commission as required by the Atomic 14 Energy Act of 1954. The Authority shall be responsible for

15 compliance with the license for the monitoring and security of i
18 the reactor and all nuclear systems and radioactive compo-t 17 nents in the vessel and for filing all reports that may be re-18 quired as the licensee.
19 SEC. 4. Any funds appropriated pursuant to authoriza-20 tions contained in the Acts of October 21,1975 (89 Stat.
21 611; Public Law 94-121), July 14,1976 (90 Stat. 937; Pub-22 lic Law 94-362), August 2,1977 (91 Stat. 419; Public Law 23 95-86), and October 10,1978 (92 Stat.1021; Public Law 24 95-431) are authorized to be used for preservation work on 25 the nuclear ship davannah. Expenditures authorized by the

4 1 preceding sentence for the preservation of the nuclear ship 2 Savannah shall not exceed that amount which the Secretary 3 of Commerce, in the Secretary's discretion, determines to be 4 necessary to make the vessel suitable for use by the Patriots 5 Point Development Authority pursuant to section 1 of this 6 Act. No part of any funds authorized to be expended by this 7 section shall be obligated or expended except in connection 8 with work which the Secretary of Commerce determines 9 would otherwise be performed on the nuclear ship Savannah 10 if the vessel were to be laid up in the National Defense Re-11 serve Fleet pursuant to section 11 of the IIerchant Ship 12 Sales Act of 1946 (60 Stat. 49).
13 SEC. 5. There are authorized to be appropriateil such 14 sums as may be necessary to tow the nuclear ship Savannah 15 to a site at Patriots Point at 3Iount Pleasant, South Carolina, 16 and to inspect and maintain the hull of the nuclear ship Sa-17 vannah below the waterline during the term of the charter I
18 and any renewals thereof.
