This is in response to your letter of November 27, 1979 in which you requested an exemption from the "same day" requirements of 10 CFR 70.54 regarding the preparation and distribution of Form DOE /NRC-741.
We have determined that the granting of this request will not adversely affect the common defense and security, is in the public interest, and is consistent with a pending modification to the instructions for preparation of Form DOE /NRC-741.
Secondarily, the wording of License Condition 3.6 is being amended to more clearly indicate its applicability to uranyl nitrate solution possessed at the Columbia facility.
Both of these changes were discussed with Mr. Harold Foster and consensual agreement concerning acceptability and wording of the license conditions was reached. Accordingly, Material and Plant Protection Amendment MPP-1 to your Special Nuclear Material License No.
SNM-1107 is hereby amended, effective imediately, by revising License Condition 3.6 and adding new License Condition 6.8 as set forth in the enclosure.
Since revision of the instructions for preparation of DOE /NRC-741 was already contemplated, no fee will be charged for this change.
