This is in further response to Mr. Anthony Z. Roisman's letter dated July 18,1977, in which he requested, pursuant to the Freedom of Information Act, copies of the case histories prepared by NRC for all special nuclear material licensees that have or have had strategic quantities of special nuclear material.

Our previous responses have addressed the case histories and comments on case histories identified as items 1 through 8 and item 10 of Appendix A.

Portions of the case history identified as item 9 of Appendix A contain information which identifies procedures for safeguarding licensed special nuclear material or detailed security measures for the protection of a licensed facility or plant. This information is considered commercial (proprietary) information pursuant to 10 CFR 2.790(d).

In addition, some material has been determined to be confidential business (proprietary) information. All of this information is being withheld from disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C.

552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations. The releasable portions of this document are being placed in the NRC Public Document Room, 1717 H Street, N.W., Washington, DC.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt frcm production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Victor Stello, Director, Office of Inspection and Enforcement.

This denial may be appealed to the Commission's Execuitve Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the 1653 234 jgj 7912140

Executive-Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

This completes action on this request.
