Niagara Mohawk Power Corporation Syracuse, New York 13202 Docket No. 50-220 (License No. DPR-63)

Nine Mile Point Nuclear Generating Station

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTIES - $18,000 This is to inform the Commission that a Notice of Violation and Notice of Proposed Imposition of Civil Penalites in the approximate amount of Eighteen Thousand Dollars (S18,000) will be issued to Niagara Mohawk Power Corporation about June 5,1979.

This action is based on six alleged items of noncompliance with NRC regulations and/or license conditions; all of which deal with site security.

Items of noncompliance associated with the site security program are:

failure to maintain an adequate fence; failure to maintain intrusion alarms in operable condition; fai'ure to control all points of personnel access into a protected area; failure to keep certain access doors locked; failure to investigate intrusion alarm; failure to maintain proper records of intrusion alarm. None of the items of noncompliance involved an immediate threat to the public health and safety.

A news release has been prepared and will be issued about the time the licensee receives the Notice.

The State of New York will be notified.

It should be noted that the licensee has not been specifically informed of the enforcement action.

Following NRC staff evaluation of the response, the civil penalties may be remitted, mitigated, or imposed by Order.
