IMPOSITION OF CIVIL PENALTIES - S18,000 Ey EN-79-04, dated June 1,1979, the Commission was notified of the intent of IE o issue a Notice of Proposed Imposition of Civil Penalties in the amount cf Eighteen Thousand Dollars (518,000) to the Niagara Mehawk Power Corporation.

Niagara Mohawk. Power Corporation License No. DPR-63 Syracuse, New York 13202 Docket No. 50-220 Nine Mile Point Nuclear Generating Station Subiect:

IMPOSITION OF CIVIL PENALTIES - $18,000 By EN-79-04, dated June 1, 1979, the Commission was notified of the intent of IE to issue a Notice of Proposed Imposition of Civil Penalties in the amount of Eighteen Thousand Dollars ($18,000) to the Niagara Mohawk Power Corporation.

The proposed penalties were based on six items of noncompliance associated with th; site security program.

These items of noncompliance included: failure to main;ain an adequate fence; failure to maintain intrusion alarms in operable condition; failure to control all points of personnel access into a protected area; failure to keep certain access doors locked; failure to investigate intrusion alarm; failure to maintain proper records of intrusion alarm.

None of the items of noncompliance involved an immediate threat to the public health and safety.

The Notice war issued on June 5, 1979, and a news release to that effect was made on June 7, 1979.

The licensee responded to the Notice of Proposed Imposition of Civil Penalties in a letter dated June 22, 1979.

After consideration of the licensee's response the IE staff concluded that the items of noncompliance did occur and that the penalties proposed should not be mitigated.

Accordingly, an Order Imposing Civil Monetary Penalties in the amount of Eighteen Thousand Dollars $(18,000) has been issued today.

The licensee and the State of New York are being lnformed by telephone.

Since this matter has been the subject of an NRC news release, no additional release is planned.

The Of fice of Public Affairs will respond to inquiries as received.

Under the terms of the Order, the licensee may, within Twenty days of the receipt of the Order, pay the civil penalties or request a hearing.
