This refers to your application dated August 1,1979, requesting an amendment to Special Nuclear Material License No. SNM-1506 to modify Item 6, authorized materials, to include material subject to the requirements of 10 CFR Part 73.

The current license authorizes, among other things, Westinghouse Electric Corporation to possess byproduct, source, and special nuclear material in packages approved pursuant to 10 CFR Part 71 and deliver sch material to a carrier for transport at any licensed facility within the United States provided the material is not subject to the requirements of 10 CFR Part 73.

Because of the recent amendments to Part 73, shipments of spent fuel are now subject to safeguard requirements. Therefore, under its exi. sting license (SNM-1506), Westinghouse is now prohibited from taking possei,sion of spent

fue'l packages at NRC-licensed reactor sites.

It is our pol' icy that NRC licensees are responsible for activities involving licensed material conducted on their site.

Therefore, we are not issuing licenses that pennit persons, such as Westinghouse, to take possession of loaded packages at licensed facilities for purposes of delivering to a v.erier for transport.

Accordingly, your application of August 1,1979, for an amendment to Special Nuclear Material License No. SNM-1506 is denied. This action is consistent with previous decisions we have made in similar license applications.
