In accordance with the Commission's guidance at its meeting on October

, Export 10, 1979, in the matter of Westinghouse Electric Cort:oratica te the Philippines -- Application Nos. XR-120 (Dkt. No. 50-574), XCOM-0013 and XSNM-1471), this is to inform you of the status of the Center for Development Policy's (CDP) request of October 5,1979, for assignment of, investigatory personnel.

On October 3,1979, Lindsay Mattison, Director of CDP, wrote James R. Shea, Director of International Programs at NRC, charging that Ebasco Services, the consultants who prepared the Preliminary Safety Analysis Report for the Philippine National Power Commission, had engaged in a coverup' of technical evidence about the seismic and volcanic risks of the site of the pro-posed reactor in this export matter.

CDP's charges have been referred to:

1.

The Department of State for transmittal to the Philippines (see enclosed letter); and 2.

NRC's Office of Inspector and Auditor, which is charged, pursuant to its delegation of authority, with, among other things, the responsibility of referring possible violations of law to the Department of Justice, or other appropriate bodies, for investigation and prosecution (see enclosed memorandum).
