Dear Mr. Neidig:
This is in reply to your request, dated July 19, 1967, for an exc=ption from the provisions of Section 50.10(b),10 CFR Part 50 of the Co=nission's rules, pursuant to Section 50.12 of the rules, to per=it the perfor=ence of certain work at tho site of the Three Mile Island nuclear Station Unit 1 prior to the issuance of a con-struction por=it by the Co= mission.
You state that the pouring of concreto for the tendon access gallory, which vill be located below the mMn contai== cut mat, must be author-ized before you can proceed with certain other pre-construction work such as pouring the concrete mud cat to provido a working surface in the bottom of the reactor building excavation and the placement of reinforcing bars for the reactor building b:so slab. You further stato that scheduling of the construction of the gallery is important to permit adhorcuce to your schedule for co=pletion of the plant.

Vo havo carefully reviewed your request described in your July 19th letter, for an exc=stion under the provisions of Section 50.10(b) and the reasons set forth in support thereof, and have concluded that the granting of the proposed enc =ption is authori:cd by Icw, will not endanger life or property or the co==on defense and security and is othorviso in the public interest. Accordingly, the Con.ission hereby authorizes you to construct the tendon access gallery for Unit 1 at the Three Milo Island Nucicar Station site, as requested in your letter of July 19, 1967, prior to the issuance of a construction permit.
