SUMMARY

OF THE SEPTEMBER 11, 2019, PUBLIC TELECONFERENCE REGARDING THE INSPECTIONS, TESTS, ANALYSES, AND ACCEPTANCE CRITERIA IN NUSCALE POWER, LLCS DESIGN CERTIFICATION APPLICATION On September 11, 2019, a Category 1 public teleconference was held between the U.S.

Nuclear Regulatory Commission (NRC) staff and NuScale Power, LLC (NuScale). The purpose of the meeting was to discuss the inspections, tests, analyses, and acceptance criteria (ITAAC) to verify radiation shielding of the reactor building and radioactive waste building.

The meeting notice was posted on the NRC website and is also in the NRCs Agencywide Documents Access and Management System under Accession Number ML19217A102. The Meeting Summary is provided as Enclosure 1, which captures the summary of topics discussed.

The Meeting Agenda and List of Attendees are provided as Enclosures 2 and 3, respectively.

SUMMARY

September 11, 2019 Revision 2 of the NuScale Power, LLC (NuScale) design certification application (DCA)

(ADAMS Accession No ML18310A238) included the following tables as Tier 1 information:

• Table 3.11-1, Reactor Building Shield Wall Geometry,; and

• Table 3.12-1, Radioactive Waste Building Shield Wall Geometry.

These tables were referenced in the acceptance criteria for associated inspections, tests, analyses, and acceptance criteria (ITAAC) (i.e., ITAAC Number 4 in Table 3.11-2, Reactor Building ITAAC and ITAAC Number 12 in Table 3.12-2, Radioactive Waste Building ITAAC).

In Revision 3 of the DCA (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML19240A813) NuScale removed Tables 3.11-1 and 3.12-1 based on their reading of SECY-19-0034, Improving Design Certification Content, dated April 8, 2019 (ADAMS Accession No. ML19080A032). The associated ITAAC were also revised to eliminate references to these tables.

The U.S. Nuclear Regulatory Commission (NRC) staff began the meeting by stating that it had no comments on the removal of Tables 3.11-1 and 3.12-1 and the revised wording of the associated ITAAC in DCA Revision 3. The staff noted that DCA Revision 3, Tier 2, Table 14.3-2, Shared/Common Structures, Systems, and Components and Non-Structures, Systems, and Components Based Design Features and Inspections, Tests, Analyses, and Acceptance Criteria Cross Reference, provides a discussion of ITAAC Number 4 in Table 3.11-2 and includes the following statement:

Radiation shielding is provided to meet the radiation zone and access requirements for normal operation and post-accident conditions, and to demonstrate compliance with 10 CFR 50.49, GDC [General Design Criteria] 4, and PDC [Principal Design Criteria] 19.

The NRC staff commented that this list of regulations should be revised to include Title 10 of the Code of Federal Regulation (CFR), Section 50.34(f)(2)(vii), General Design Criteria 61, and equipment survivability requirements and that similar revisions should be made to the Table 14.3-2 discussion of ITAAC Number 12 in Table 3.12-2. NuScale stated that for ITAAC Number 12 in Table 3.12-2, some of these requirements would not apply. The staff agreed with this statement and responded that all relevant requirements should be included in Tier 2, Table 14.3-2 discussions.

Enclosure 1

NuScale stated that they understand the NRC staffs concerns and will propose a revision to the Table 14.3-2 discussions of ITAAC Number 4 in Table 3.11-2 and ITAAC Number 12 in Table 3.12-2.

There was an opportunity for members of the public to provide comments and ask questions.
