SUBJECT:

INTERIM ACCESS AUTHORIZATION FOR DALE R. COLLINS On Novem]er 17, 1978, the National T.easury Employees Union (NTEU) was certified by the Department of Labor (DOL) as the exclusive representative for e collective bargaining unit consisting of all professional and non-professional employees in NRC Headquarters, with certain exceptions. NTEU also has in progress a campaign to organize the professional and non-professional employees in NRC's regional offices. This certification sets the stage for the beginning of negotiations on a labor agreement between NRC management and NTEU with regard to personnel pclicies, practices, and matters affecting working conditions of bargaining unit employees.

NRC management has determined that it is in tae best interest of the agency to have someone with indepth experience in stress negotiating situations with an aggressive union such as the NTEU to serve as the Chief Negotiator in the upcoming bargaining sessions.

Since the Labor-Management and Employee Relations Branch has recently been allocated an additional personnel slot, it was decided that is would be appropriate to hire a Labor Re'ations Special-ist who had negotiating experience with NTEU, thus meeting both the short and long term needs of the Agency. The vacancy announcement was posted and the merit selection process has recently been completed. The individual selected for the position is Mr. Dale R. Collins from the Internal Revenue Service.

Negotiations on a labor agreement with NTEU will very possibly commence in February of 1979 with receipt of a union proposal anticipated as early as January 1979.

There is a possibility that NTEU will earlier reguest to negotiate an interim agreement on items that will evrntually be provided in the agreement, such as dues checkoff.

In order that Mr. Collins be permitted the maximum. time possible to learn the NRC's personnel policies

2-and practices (established under NRC's excepted status as opposed to an agency in the competitive service) in preparation for the upcoming bargaining sessions, it is important that he be brought on board as soon as possible.

Thus the Division of Organization and Personnel is requesting that an Interim Access Authorization be granted under subsection 145b of the Atomic Energy Act, as amended.

Unless such an Interim Access Authorization is granted we believe ti,at the subsequent delay in tine for the "L" clearance to be granted will have a detrimental impact on NRC's ability to negotiate a successful first contract with NTEU. Mr. Collins will not require access to classified material during this period prior to completion of the security processing.

I certify that results of prcemployment checks have disclosed no derogatory information. Mr. Collins' curent supervisor and two previous supervisors were contacted by Personnel as part of the background reference checks and none of those contacted disclosed any derogatory information concerning him.

I trust this memorandum is sufficient to meet our needs.
