APPROVAL UNDER SECTION 145b. OF THE ATOMIC ENERGY ACT OF 1954, AS AMENDED, FOR THE EMPLOYMENT OF DALE RICHARD COLLINS Issue:

The Director, Division of Organization and Personnel, Office of Administration, has requested Commission approval to employ Dale Richard Collins as a Labor Relations Specialist prier m the completion and evalua-tion of the required national agancy check and inquiry.

Discussion:

The Director, Division of Organization and Personnel, has certified that unless Mr. Collins is employed by the Nuclear Regulatory Commission (NRC) prior to the comple-tion of his security investigation, NRC's ability to negotiate a successful first contract with the National Treasury Employees Union might be adversely affected.

Mr. Collins has been employed by the Internal Revenue Service (IRS) s1nce 1968.

He was the subject of a 1968 national agency check conducted by the "ivil Service Commission and a 1969 full field backgre.nd investiga-tion conducted by the IRS.

The Personnel Security Questionnaire of Mr. Collins has been favorably reviewed.

Initial Federal Bureau of Investigation checks have revealed no deregatory information.

Additionally, the Division of Organization and Personnel has advised that the preemployment checks conducted on Mr. Collins con-tain no derogatory information.

Recommendation: The Commission:

1.

Determine pursuant to Section 145b. of the Atomic Energy Act of 1954, as amended, that the employment of Mr. Collins as a Labor Relations Specialist is clearly consistent with the national interest.

2.

Determine that Mr. Collins be precluded through administrative procedures from having any access to Restricted Data or National Security Information pending completion of the required security investi-gation and a favorable determir.ation as to his eligibility for security clearance.

Coordination:

The Director, Division of Organization and Personnel, concurs in and the Executive Legal Director and the Division of Security have no objection to the recommen-dations contained in this paper.
