Dear Mr. Cochran:
The Department of Energy has referred several documents to the Nuclear Regulatory Commission for our review and direct response to you.
These documents are subject to your Freedom of Information Act request to DOE, dated February 3,1978, concerning unauthorized transfer of strategic quantities of special nuclear material.
These documents were included in Document #67 of F01A-77-106 (A. Kranish) the released portions of which are available at the NRC Public Document Room,1717 H Street, N.W., Washington, DC 20555.
Appendix A, enclosed, 4
identifies the documents referred by DOE, their page numbers in Document
- 67 of F01A-77-106, whether they were released or denied, the exemptions cited, and the denying officials for the withheld documents or portions

thereof.
Pursuant to 10 CFR 9.9 of the Commissions' regulations, it has been

determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the undersigned and the appropriate agency listed in Appendix A.
This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
