This office has received a copy of your Proposed Change No.167 dated September 24,1979 (WYR 79-108/PC-167-1), relating to secondary water chemistry monitoring (SWCM), which was filed with the Office of Nuclear Reactor Regulation (ONRR) for review and approval.
The application is for the Yankee Rowe facility (License No. OPR-3).
Your application was not accompanied by a fee as prescribed by 10 CFR 170.22 because you determined that the license condition for SWCM, when incorporated in the Yankee Rowe facility license, will serve only to define the requirements for a program similar to the program that has been in effect at the facility since 1960 and the amendment would be strictly for license clarification purposes and for the

convenience of the Comission and, as such, is not subject to fees.
Based on guidance from the ONRR staff as a result of their review of your proposed change, it has been determined that the change requires a Class II amendment fee of $1,200 because the review will deal with the administrative aspects of SWCM requirements and the amendment will be pro forma in nature.
It is our understanding that the applications filed by licensaes relating to SWCM are not being requested for the convenience of the Commission, rather they are considered an acceptable solution to prevent the potential problem associated with steam generator tube integrity.
The fee schedule of 10 CFR 170.22 was established based on average costs for various types of actions using manpower data for FY 1977.
Therefore, some fees appear excessive while others do not nearly cover the review costs.

If the final review of your application by the ONRR staff reveals that this fee is incorrect, you will be refunded any overpayment or billed for any additional amount due.
