I am pleased to respond to your letter of August 2,1979, requesting the views of the NRC on an article in the Jacksonville Daily News, headed "MOREHEAD PORT !%Y RECEIVE NUCLEAR WASTE," and to have this opportunity to comment on the rationale for returning some foreign nuclear material to the U.S.
The Nuclear Regulatory Commission has not licensed the import of high-level or transuranic wastes for storage or management in the U.S.
Neither have we specifically licensed the import of low-level foreign wastes for disposal in the U.S.
Since source and byproduct materials may be imported under general license, without case-by-case review, by any person authorized by the NRC or an Agreement State to possess the caterial, the possibility exists that some low-level wastes couta be imported for disposal in an authorized disposal facility, but we are not aware that this hu actually occurred. The NRC does license the import of nuclear materials for research, developmental and commercial purposes and these activities may ultimately result in the generatien of some wastes wilich are disposed of in domestic storage facilities.
This would be the case, for exa:mle, in the import of experimental fuel pins for destructive assay and analysis.
No sper t, low enrichec light water power reactor fuel has been imported from 6 broad for storage, management, or reprocessing in the U.S.
However, the U.S. does offer fuel reprocessing services in Department of Energy (DOE) facilities for domestic research reactors and for some foreign research reactors.
It is the nuclear material from those foreign test and research reactors to which the article in the Jacksonville Daily News refers.

- This particular kind of spent fuel contains valuable, recoverable high enriched uranitri which, after reprocessing, is reusable as reactor fuel.
Plutoniun production in such fuel is minimal.
For some years it has been the practice of the DOE and its predecessor agencies to reprocess the spent fuel under contract with the owners of foreign research reactors.
The waste material resulting from the reprocessing of foreign fuels, amounting to less than 2% of the total wastes generated in all DOE reprocessing operations, is stored at the DOE site along with waste resulting from docestic activities. The tenns under which this material is accepted are set forth in 33FR30 dated January 3,1968, as amended most recently in 41FR36244 dated August 27, 1976.
During the next 12 months, we expect about 60 such shipments to enter east coast ports and then be shipped by surface transport to the DOE Savannah River Plant near Aiken, South Carolina. Some similar shipments may enter the U.S.
through west coast ports for shipment to DOE facilities in Idaho. The U.S. Government considers acceptance of this material as making an icportant contribution to U.S. efforts to reduce the risks of proliferation of nuclear weapons to other countries by maintaining U.S. controls over the highly enriched uranium, by reducing inventories of HEU abroad, and by reducing the pressures in other countries for indigenous reprocessing and HEU enrichment capabilities.
Secretary of State Vance pointed out the nonproliferation benefits of return of foreign research reactor fuel to the U.S. in a letter to Senator Jackson dated September 12, 1977 in which he noted that "the administration believes that these contracts, ur. der which sper.t highly enriched uranium is returned to the United States, are vitally important to our nonproliferation policy."
The shipments enter the U.S. under the tenns and conditions of import licenses issued by the NRC. The shipments are subject to NRC and Department of Trar.sportation regulations until they reach the DOE facility, after which they become the responsibility of DOE.
In general, ir. accordance with the Atomic Energy Act of 1954, the NRC would issue such import licenses after caking a determination that the imporc activity would not be inimical to the connon defense and security of the U.S. and would not constitute an unreasonable risk to the public health and sa fety.
The safety and safeguards of these and other nuclear shipments are a subject of continuing review by the NRC. To ensure the safety of the public, we require that shipaents be made in casks which are designed to withstand very severe accidents.
From this viewpoint, our recent studies have shown that no additional regulations are needed.
However, a recent study indicates the possibility of serious consequences to public health and safety if one postulates successful sabotage of a power reactor spent fuel shipcent in a heavily populated area. Although our studies have revealed no identifiable threat to spent fuel shipments, and although the casks are highly resi tant to sabotage, we nonetheless concluded that it would be a prudent precaution to issue interim regulations for the protection of both power re' actor spent fuel shipments and research reactor spent fuel shipoents against sabotage.

The Honorable Charles 0. Whitley were issued on June 15, 1979 and became effective on July 16, 1979. We also published another document, designated NUREG 0561 (also enclosed), which provides guidance for licensees in complying with the interim regulations.
We expect that these requirements will continue in effect until we can obtain results from an on-going research program designed to determine the vulnera-bility of spent fuel and spent fuel casks to attempted sabotage and the related parameters necessary to estimate the health and safety consequences. At that time, about one or two years hence, these new requirements may be amended, rescinded, or made pennanent, as appropriate.
The thrust of these re:ulations is to protect spent fuel shipments against sabo-tage in heavily populated areas.
This is to be done through a series of measures including route restrictions, preplanning of shipments, and coordination with local law enforcement agencies along the route to provide assistance if needed.
It is the preliminary staff work of looking at various possible ports-of-entry that apparently gave rise to.the newspaper article included with your letter.
In October 1977, President Carter announced the proposed U.S. Spent Fuel Policy, stating that the federal government will take title to and accept spent fuel from domestic nuclear power reactors for storage and, on a limited basis, from foreign reactors when this will contribute to meeting U.S. nonproliferation objectives.
The Spent Nuclear Fuel Act of 1979, submitted to Congress in February 1979 would provide the implementation of.this policy. As previously noted, however, there is no foreign commercial reactor fuel being stored in the U.S. and there are no conritments to receive this type of material at this time.
