Dear Mr. Williams:

I am writing to advise you that effective September 30,1999, we will expect route approval applicants to conduct route coordination with states and local law enforcement agencies. In the )

past, as a convenience, the U.S. Nuclear Regulatory Commission (NRC) has assisted applicants by coordinating with local and state law enforcement agencies. However, we can no longerjustify spreading the cost of the coordination noted above to other licensees that derive l no direct benefit from the activity. As a result of this change, after the effective date, the j coordination activity to meet the requirements of Title 10, Code of Federal Regulatior.s (10 CFR) Sections 73.37(b)(6) and (7), will be conducted by applicants and the route plan application will need to include coordination results and details. I am enclosing a content guide for your use in preparing spent fuel route plan applications. A sample NRC route plan approval (Safeguards Information)is also enclosed.

Your application will be reviewed by staff, and used by regional staff in conducting route surveys (if required). If found acceptable to staff, the application will serve as the basis for your NRC route approval. If the application is found inadequate, we will send you a Request for Additional Information, and we will suspend processing of your apphcation until we receive a response. So that regional staff may be available to conduct route surveys, if necessary, please submit your application no later than 45 days prior to your anticipated shipping date.

Finally, please note that NRC will continue to interact with federal law enforcement agencies, and with Governors or their designees regarding spent fuel shipments.

Dear Mr. Williams:

I am writing to advise you of changes in our procedures for approving spent fuel shipment route <

plans. Effective June 30,1999, the U.S. Nuclear Regulatory Commission (NRC) staff will no longer provide route coordination with states and local law enforcement agencies. We cannot justify spreading the cost of the coordination noted above to other licensees that derive no direct benefit from the activity. As a result of this change, after the effective date, the coordination activity to moet the requirements of Title 10, Code of Federal Regulations (10 CFR) Sections 73.37(b)(6) and (7), will be borne by applicants and the route plan  !

$ 1 Content Guide for Spent Fuel Route Plan Applications

1. The application should follow NUREG-0561 (copy enclosed) format, and be submitted in both hard copy and word processing file format (Word Perfect 8.0 preferred, but not required).
2. The application should include a summary map, and maps for each state, that identify the origination and destination facilities, and the complete route that will be used for the shipment. The maps should be accompanied by tables that specify for each state, the route segments used, driving directions, and segment and accumulated route distances.

The maps should also show state, county and urban area boundaries. (Note: we prefer that the maps be incorporated in the word processing files, but this is not required. If maps are hardcopy only, xerographic copies of the maps must be legible.)

3. The application should document that the route complies with the U.S. Department of Transportation routing requirements (49 CFR 397 Subpart D). For shipments by road, output from the U.S. Department of Energy's HIGHWAY routing code showing that the requested route is the minimum distance route is acceptable. A HIGHWAY route that is not the minimum distance route, but is shown to be the minimum time-in-transit route, is also acceptable. Routes that are neither minimum distance nor minimum time-in-transit are acceptable if the application documents that affected states and tribes agree to use of the route, and that the U.S. Department of Transportation approves the route.
4. The application should indicate by jurisdiction the name(s) and telephone number (s) that will be current at the time of the shipment for contacts for theft / sabotage, and for other transportation emergencies. Note that in some areas, a single state-wide contact is available, and that in other areas, different contacts are needed for different types of transpoitation incidents in each county or urban area through which the shipment ,

passes. The contact information may be incorporated in the tables described in item 2. l The objective is to make it easy for the driver to find out who to call based on where the vehicle is located at the time of the incident.

5. For highway routes, the application should identify candidate safe-havens on the maps at about 50-mile intervals along the route (for safe-haven qualifications, see NUREG-0561).
6. The maps and tables should indicate urban areas requiring armed escorts (see NUREG-0561 for details), and plans for providing the armed escorts.
7. If required information is not available at the time of the application, please identify that information and when you will provide it to us. Note that we will not be able to take final action on incomplete applications until additional information is received, reviewed, and accepted.
