AFFIDAVIT OF EDWARD LANTZ I, Edward Lantz, being duly sworn to depose and state:

I have been previously sworn in this proceeding and testified at the McGuire/0conee hearings on the Oconee spent fuel transportation application on Wednesday, September 12, 1979 (Tr. 4433-57).

My testimony was offered in response to Boa'rd questions related to compliance with 10 CFR Part 100

. requirements and to whether criticality would occur if the twenty-five ton truck cask used to transport Oconee spent fuel was assumed to fall into the McGuire spent fuel pool.

My testimony on September 12, 1979 z page 4439 of the McGuire/0conee Docket No. 70-2623 transcript may be read as indicating that it is the general practice to withdraw the control rods out of the core while a reactor is shutdown for refueling.

This is not the case.

The control rods are not ordinarily removed from the core during refueling.

I intended to convey the point that during refueling the baron con-centration of a reactor is such that if for some reason the control rods were I911010O

. to be removed during a refueling shutdown, the boron concentration is adequate to maintain the core reactivity in a subcritical state.

Accordingly, my testimony at transcript page 4439, lines 19-25, should be read with "if for some reason" added at line 20 after the word " reactor" and before the word "they".
