MOTION TO CORRECT THE RECORD WITH RESPECT TO NRC STAFF TESTIMONY IN RESPONSE TO BOARD QUESTIONS RELATIVE TO THE POSTULATED CASK HANDLING ACCIDENT On September 11, 1979 during the course of the hearing, the Atomic Safety and Licensing Board asked the NRC Staff to respond to Board questions relative to a postulated cask handling accident. scenario in which the twenty-five (25) ton truck cask used to transport Oconee spent fuel to McGuire was assumed to fall into the McGuire spent fuel pool.

The Board questions concerned whether compliance with 10 CFR Part 100 dose requirements would be maintained and whether criticality could occur.

On September 12, 1979, NRC Staff witnesses were presented to respond to the Board's questions.

In responding to the general Board question with respect to the criticality matter, the NRC Staff witness, Mr. Edward Lantz, as part of his testimony, described a part of the procedure generally followed during refueling of a reactor.

He described generally how the control rods and the refueling concentration of horon is utilized.

Although not pertinent to the 1282 7911010'O5f

. main point of Mr. Lantz's testimony relative to the boron concentration found in the spent fuel pool, the context of Mr. Lantz's testimony at that point does not clearly convey the refueling circumstances with respect to how the control rods and the boron concentration in the reactor core are used in conjunction to control criticality during refueling.

Accordingly, in order to correct the record with respect to the testimony concerr,ing the control rods and boron concentration at a reactor refueling shutdown, the NRC Staff moves the Board to admit in this proceeding the attached nifidavit of Edward Lantz.
