Commission review of proposed issuance of subject license to Westinghouse Corporation.

Review Dates:

60-day period expired en August 11, 1979.

120-day period expires on October 10, 1979.

Discussion:

In March 1979, Westinghouse Electric Corporation applied for a license to export 727,175 kilograms of uranium, enriched to 3.5'.', to South Korea ( Aapendix AT. This material would be in the form af fuel assemblies for the KCRI-2 facility near Pusan.* The amount of fuel requested would be sufficient to cover the initial core and 40 reloads over a per cd extending to the year 2023. Th's request was based u::en the aoplicant's projected life expectancy of the reactcr.

The staff notes that the Deoar: rent of Energy has contracted to supply urani.m enrichment tervices for KCRI Unit 2 over a 30-year period ?.xtending to Seatember 30, 2009.

Capiss of the license aoplication were forwarded to the Commissicn en March 15 'SECY-79-132'. On June 20 the Ccmissicn was provided ccpies of the Executive 3 ranch views en the apolicaticn (SECY-79-lS2A1. These views, as subsequently revised by the Executive 3 ranch, are also attacned at A:pendix 3.

The Executive 3 ranch, in its June 11 comments, rec n ended that NRC authcrization be limited to an initial core, essential spares and three reloads over a pericd not to exceed five years. The staff, after censultation with Westinghouse, advised the Department of State that, because of the shipoing and loading schedules, an eight-year validity pericd wculd be b 7910310(

In this regard, the key dates for the cperation of the KCRI-2 reactor are as follows:

Initial Shipment Date January 1981 Initial Leading:

December 1987 The staff notes that the first shipment is not scheduled to take place before 1981.

Mcwever, Westinghouse has advised IP that early issuance of the license has been requested since the Export / Import bank loan to pay for this material would include funds for the yellowcake and enrichment involved and the bank requires that a license be issued before funds are made available.

The Executive Branch subsequently advised the sta#f that its ccaments shculd be revised to read "... that the validity cf the license be limited to a pericd of eight years beginning January 1, 1981, the date of the first shi; ment, and exciring Cecember 31, 1988..." The remaining condition, limiting the authorization to include only the initial ccre, essential spares, and three reloads. remains uncnanged.

The staff finds the limitaticns prcposed by the Executive Branch to be reascnable and censistent with recent Commissicn licensing action involving multiple relcads.

In this regard, the staff notes that while the Commission aas shcwn a preference for accroving such exports with a validity pericd of five years, the Laguna V?rde request acproved in April involved 377,5C0 kiic;ra.rs cf uranium to be experted over a period of te years.

. Further, the staff believes that the primary issue in approving an export should be the quantity of material involved rather than the validity period of the export license.

In this regard, the staff notes that SNEC discussions related to this request were primarily centered on the number of reloads to be approved. After the interagency group determined that the approval of the initial core, essential spears. and three reloads

  • was reasonable, it was believed that a license validity period of five years womld be sufficient to allow this export. However, as noted above the shipping of that

'uantity of material would require a license valid for at 2ast eight years, based on the reactor's operation schedule. Co7sequently, it was deternined that the license should be issued with a validity period of eight years.

In connection with its review of this application, the Executive Branch has (1) concluded that issuance of the license, if revised as propcsed, wculd not be inimical to the interests of the United States, including the ccomon defense and security: (2' confirmed that the material aill be subject to the U.S.-Korea Agreement for Cooperation; (3) confirmed that Korea has achered to the provisions of the Kor ea Agreement for Cccceraticn with the United States; and (4) advised that there are no material changed circumstances since the submissicn of its detailed analysis of February 23, 1979 for license application XUCSa36.

/I:alication XUG8436 was submitted by Edlow International for the export of 10,0C0 kilegrams of depleted uranium to Korea. The applicaticn was subsequently amended, after the receipt of Executive Branch views, to reduce the quantity of material to 9,500 kilograms.

In accorcance with 10 CFR 110.40(b)f3), an application for the ex;cet of less than 10,CC0 kilegrams of sourca material does not require Ccmmissicn review; acccrdingly, a: plication XUCS436 was not forwarded to the Ccmmission. A copy of the Executive Branch views on a: plication XU0SJ36 is being forwarded with thispaper(AppendixCJ/.

The staff believes that there are no material changed circumstances concerning experts to Korea unich wculd affect the Ccamission's censideration of licensing criteria and wnich have cccurred since issuance of ex; ort license XSNM-Il73 for HEU to Korea after Commission review.

Accordingly, the staff believes that this procesec.<;crt license may be issued. This procedure is authori:ed ty 5110.4a(a'(2' of ? art 110 and is based on Sectico 125(3'(2) of the AEA as amended by the :luclear "orcroliferaticn Act of 1973. The staff has concluded that this ex:crt wculd not be inimical to the corren defense and security of the U.S.

In response to issues raised by Commissioner Bradford on March 27 concerning this request, the staff notes that the application is no longer being considered for 40 reloads, as originally requested.

Further, the staff forwarded comments regarding spent fuel disposition plans in South Korea to the Ccanission by memorandum of December 14, 1978 (SECY-78-653). We understand from the Department of Energy that information on these plans, provided in the Boeing Engineering and Construction January 1978 study, " Global Spent Fuel Logistics System Study," is still current.

Further in response to Commissioner Bradferd's request, the Executive Branch has not yet adopted a generic position with regard to the number of reloads which may be accroved in a single application. Each request is currently considered on a case-by-case basis.although there is an inclination tcward approval of licenses covering utility requirements for accroximately five years from date of first shipment. The staff believes that it would not be prudent for NRC to unilaterally adcot a gt.eric policy regarding the number of reloads to be considered in a single application.

In the staff's views i: would be preferable for the Ccenissicn to await the ccepletion of the Execucive 3 ranch's review of this matter ::efore the Cennission adopts its _ final position. The staff is being kept informed of the status of the Executive 3 ranch's review of the multiple reloac cuestion througn NRC's membership on the Subgroup on Nuclear Ex;crt Cccrdinaticn

/SNEC).

In addition, the folicwing is provided in resconse to Ccmissioner Ahearne's questicn of July 9 concerning a similar excort to Korea which is ::resently being reviewed by the staff (XSNM-1455, SECY-79-143A).

How far in the future will 40 reloads go?

Forty reloads would cover a span of approximately 40 years.

2.

Have any other execrt licenses covered this many reloads?

No.

3.

What confidence can staff / State orovide that their Judgments wlli holo that far in the future?

Neither State nor the staff can confidently determine that its assessment of the situation in a country will endure for such an extended period of time. Accordingly, the Executive Branch has reccamended, and the staff has agreed, that the export at hand be limited to an initial core and three' reloads (or approximately eight years after the date of first shipment}.

4 Will State's recommendation fer five years cover the three reloads?

As noted above, State has subsequently changed its position and recommended that the validity of the license extend ever a period of approximately eight years from the date of first shipment, sufficient time to cover the three reloads.

Althcugh insufficient information is available to ccmoletely evaluate the acequacy of safeguards in Korea,

'IMSS believes that the control and accounting for reactor fuel assemblies on an item basis is within State capabilities and should pose no unusual safeguards pecblems for the IAEA.

The a.S. is providing technical support to Korea in the upgrading of its SSAC program. A safeguards analysis fer Korea,which is classified CCNFIDENTIAL, is being provided by scparate memorandum.

NMSS has reviewed the orogran in Korea for the physical protection of Icw enrichec uranium and power reactors and fcund it adequate to meet the recuirements cf 10 CFR 110.42 and 110.43.

That the proposed license, as revised, be issued to Westinghouse Electric Corporation.

In accordance with P.L.95-242, the analysis explicitly addresses how the recuirements of Section 126 a. (1) 'of the Atomic Enerc.v.

Act are met, including the specific criteria of Sections 127 and 128, as well as certain additional facters, en-visaged by Section 126 a.(1).

The Executive Branch, en the basis of its review of this case, has concluded that the recuirements of the A:cmic Energy Act and P.L.95-242 have been met and that the proposed export would nc: be inimical to the common defense and security of the United States.

Moreover, the Republic of Korea has adhered to the provisions cf its Agreement for Cocperation with the United States.

Secticn 127 Criteria As provided in Section 127 of the Atomic Energy Act, the following criteria govern exports for peaceful nuclear uses frcm the United States of source. material, special nuclear material, production or utilization facilities, and any sensitive nuclear technology:

"IAEA safeguards as required by Article III(2) of the Treaty will be applied with respect to any such material or facilities proposed to ce experted, to any such material er facilities previously expor:sd and sub-ject to the applicable Agreemen for Ceeperation, and to any special nuclear material used in or produced through the use thereof."

As a non-nuclear weapon state Party to the NPT, Korea is precluded from accuiring, develeping or manu-facturing nuclear explosive devices for any purpose.

The Executive Branch has assessed the physical se-curity measures maintained by the Republic of Korea with respect to nuclear material and f acilities and de-termined "sa they are adequate for the raterial covered by this license application.

In addition, the Gcvern-ment of the ROK has provided assurances (assurance letter enclosed) that physical security measures w.11 ce main-tained, with respect to the material covered in these license ep;11 cations, in order to previde, a: a.inimum, a level of protection compartble to that envisaged in IAEA INFCIRC/225/ Revision 1.

Safecuards Implementation The IAEA Secretariat has noted in its Special Safe-guards Implementation P.eport that with regard to nuclear material sub ect to IAEA safeguards, while some de-ficiencies exist in the svstem, no diversion cf a s i c. -

nificant quantity of nuclear material was detected in any of the 45 states in which inspections were carried out.

Although recognizing the need to correct existing deficiencies in safeguards implementation, the Executive Branch has no reason to believe that the IAEA Secre-tariat's report is not valid.

In tne light of this and other f actors associated with the propcsed export, the Executive Branch believes the framework of commitments, assurances, and safeguards is adequate for the purpose of this expert.

This letter is in response to the telephonic request from your office for written confirmation of the change in the Executive Branch recommendation regarding the ap-propriate period of validity for export licenses XSNM01458 and XSNM01472 author-izing the export of low-enriched power reactor fuel to the Republic of Korea.

As you will recall, on June 11, and June 21, 1979, the Executive Branch transmitted favorable recommendations to the NRC for license applications XSNM01472 and XSNM01458, respectively.

In each case the favoracle recommendation was conditioned upon a limitation of the amount of low-enriched uranium to that sufficient for initial cores, es-sential spares and three reloads and a license validity of five years rather than the 40 ;eload/47 year licenses re-quested by Westinghouse.

Westinghouse accepted the. initial core, three reload limitation in these cases, but claimed that a five year validity period was too short even for the limited amount of material authorized for export.

Westing-house requested that the licenses be made valid for eight years from the date of first shipment.

The Executive Branch reviewed the Westinghouse request in light of the scheduling information furnished by tele-phone by the firm and concluded that eight years from the date of first shipment was a reasonable period based on the understanding that initial shipments will be mede in 1981 for KCRI 3; 1983 for KNU-5 and 198 5 for KNU-6.

Subsequent reloads will be at 18 month intervals and an additional 6 months to a year is needed to account for schedule slip-E page.

Therefore license No. XSNM01472 should be valid until December 1988 (1981 plus 8 years); and XSNM01458 should be valid until 1992 (1985 plus 8 years for Reactor KNU-6).
