Dear Mr. Hendrie:
The undersigned attorneys represent individual citizens and one citizens' group who are concerned about the threatened discharge of high-level radioactive wastes h the damaged nuclear reactor at 'Ihree Mile Is2.and ('IMI) into the Susqueharra River. The 'IMI discharge point is directly upstream from the drinking water intakes of mere than 100,000 people. This letter is to inform you that after 60 days, or before,it' the dumping of high-level radioactive waste appears iminent the citizens we represent will go to court to stop this acticn.
The citizens claim that there au.tigh-level radioactive wastes new beira; stored in the damaged 'IMI reactor. 'Ibey further claim that adequate t"eatent technology may not be available to redtcethese wastes without high risks of additional releases of radioactive pollutants into the air and the water and without massive dilution. Dilution cf radicactive pollutants with large quantities of Susqueharna River or ground water would make disposal by means other than river discharge difficult, if not impossible.
Despite such dilution, these wastes might still be at a high level of radioactivity and pose a significant threat to human h?alth. Not withstanding the fact that the entire thrust of the Clean Water Act is to " eliminate" and not to dilute pollution ( 33 U.S.C. 31251 (a) (1)) Section 1311 (f) contains a specific prohibition against the actions centemplated by the M?tropolitan F111 con Ccmpany with the approval of the Nuclear Regulatcry Conmission.
Section 1311 (f) states:
(f) Not withstanding any other provision of this chapter it shall te unlawful to discharge eny radiological, chemical, or his;h level radioactive wacte into the navigable waters.

reactor into the Susquehanna. 'Ihcy also urge the federal goverrmant to require a full and complete envircrinental impact statement analyzing all the alternatives for disposal of the radicactive wastes inside the 'IMI reactor.
