Appendix A SEP 7 Ed9 NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-373 Based on the results of the NRC investigation conducted on January 9 and 10 and August 21, 1979, it appears that certain of your activities were not conducted in full compliance with NRC requirements as noted below. These items are infractions.

10 CFR Part 50, Appendix B, Criteria IX, states in part that, " Measures shall be established to assure that special procedures, including welding,...and nondestructive testing, are controlled, and accomplished by qualified personnel. CECO Topical Report CE-1A dated January 1976, commits to 10 CFR, Part 50 Appendix B.

Also the Materials Assurance Company, Qualification and Certification of Nondestructive Examination Personnel Procedure No. MAC-77-06, Rev. 4, December 28, 1977 and SNT-TC-1A requires:

(a) a general, specific and practical test with a composite grade of 80 or greater qualification; (b) an annual eye test; and (c) the ability of an NDE Level I individual to properly perform specific calibrations, examinations, evaluations, etc.

Contrary to the above., aeasure established by the licensee did not assure that nondestructive testing performed by an NDE 3ubcontractor was accom-plished by qualified personnel. Examples are:

1.

An individual who did not have the appropriate qualifying experience, training or eye tests performed liquid penetrant examinations in accordance with ASME Section III and IV on safety related welds.

2.

An individual certified as an ultrasonic Level I inspector was unable to calibrate equipment, explain or perform any type of an ultrasonic examination.

3.

Three individuals certified as Level II examiners had not been given Level II practical examinations.
