Dear Mr. Shadis:

This letter responds to your request, dated August 8,1979, for a sixty-day extension of time within which to file coments on the NRC Advance Notice of

Proposed Pulemaking on emergency planning.

The Comission, in response to concerns raised by the Congress and by the public and in the exercise of its duty to protect the public health and safety, has determined that this particular rulemaking ought to be completed on an expedited basis by the beginning of 1980.

Accordingly, a sixty-day extension of time would compro-mise these considerations and, therefore, your formal regaest is denied. 10 CFR 2.772(b).

You should note, howev.er, that the particular advance notice you refer to is not a proposed rule but a request for coment.

The proposed rule, when published in the next two months, will provide for another opportunity for public censnent.

In addition, because the rulemaking proceeding is still ongoing, your comments, when received, can be given consideration and will not be ignored simply because you cannot meet the August 31 deadline for the first round of cocinent.

Finally, the Ccmission rulemaking proceeding will not involve formal proceedings (which would involve intervention) but is considered " informal" rulemaking, involving the solicitation, analysis, and consideration of public written connent. To that extent, your participation is not that of a party in a Commission adjudica-tien but rather, is like that of any other person or organization that chooses to comment on the proposal.
